Re: Hey Deb
OK
i won't dispute you -- Bootleg movies are illegal. The industries are not getting the money they would have gotten had I gone to the theater to see the movie.
That being said:
What about ordering the film on PPV?
What about waiting till the movie is on HBO
What about Netflix.
Yes, I am paying for those services, but the movies are not getting NEARLY the amount of money they would have gotten had i gone to the theater.
My point is, piracy and bootlegging contribues, but is it the biggest problem?
As for music, yes I "steal" music. But, you have to ask yourself, if it's so illegal, why isn't more done to stop services like Morpheus and Limewire, 2 free services that advertise pretty openly.
And, I think I should be considered half a thief, as opposed to a full-fledged one. After all, in order for me to get on the internet to download, I need to buy a computer and I also need to pay a monthly service to access the Web. So, it's not like NO money is coming from my pocket.

Little known facts. When a company like blockbuster or netflix buys a tape from the studio...they don't pay the 19.95 that we would pay for it in the store. Because those are rental houses the fee they pay PER TAPE is just over $100 (it could have gone up but when I worked there the exact amount was 101) This 101 is ON TOP of a blanket fee that the rental house pays the production house. SO it seems to you that you are paying a lot less but the production company is still getting a huge chunck of cash.
As for why isn't more being done...well plans are indeed being set up. The music industry (and I bet we hear a few quips about it on Wed night) is currently working on ways to beat the problem in a global sense rather then bandaid fixes.
Your last argument makes me giggle. Yeah, you are paying money to the computer company and the internet company...but that is for your use of thier services...not for the music and/or the movies that you are stealing.

Re: Hey Deb
i have a question though.
how is taping things off of the radio or Tv different than copying it from someones computer? we always did this when we were younger, and it wasn't considered 'illegal'. but, when the word "download" is attached to it, all of a sudden, it makes it seem like a whole different situation, when, really, its not.

Re: Hey Deb
just out of curiosity, what do you think of the fair use argument that someone else posted above? That is, one could tape off the radio onto a cassette, or make a copy of a tape onto another tape for their own use. Why can't a person "borrow" someone elses copy and make a copy for themselves? Even if it were avaiable on line, how different is that from my borrowing a CD from a friend and ripping it onto my computer and then transferring it to an MP3 player? I have actually never downloaded any music since I don't own an MP3 player, but I still think it is the same as a walkman or portable CD player, just in a different format.

Those are stealing as well. Before current technology is wasn't that big of a deal and it wasn't as big in the american public. With the use the hightened use of the internet the music industry is DEEPLY feeling the impacts of such acts. IMO, people use the term "borrow" to make themselves feel better and to not use the term "steal". If you use someone's CD to rip songs, you are not borrowing the CD you are stealing the songs. Your friend paid her/his dues to the RI, you however, have not.

Hum, I *think* the term fair use, actually permits me to make a copy of the CD I purchased and if I give that copy to a friend, that friend would not be stealing. I think that fair use is legally sufficient in a court of law. The problem the RI faces is the fair use argument and I am still not convinced that they have gotten arround that.

Re: Hey Deb
Just adding my 2 cents.
I think the difference between recording shows from TV or songs from the radio is that they were used for personal use. Now its an issue of mass dissemination.
Now with the internet and downloading, the affect is massive. When you download music on your computer while linked to the internet, you are connceted to 100's of 1000's of other people who can also obtain that music for free.
Before the internet, when you copied a song from the radio- how many people got it from you. Just a few.
I think that's the difference.

Re: Hey Deb
I see Shellyesq's point, and yes the effect on the RI is disaterous. I am not debating that point at all. I just have difficulty correlating their point on how downloading music effects them and the legal argument, that if I can make a copy of something under "fair use", and give it to a friend, that having my computer open so lots of people can obtain the same copy is any different.
That said, I think the fair use argument is not without fault though,;it is akin to the fact that it is illegal to provide copies of Microsoft office to other people that have not paid for it, yet I can use my own copy of Microsoft office on my own multiple computers.
I just wanted to see other people's perspectives on the matter.

I'm not saying that people go it FROM me after i copied it. Just that we DID copy it fro the radio, and how is that different than getting it from someone else?
we also have 100s of cable stations now, so we can copy almost any movie from TV. I dont see how that is so different.
Now, if i were downloading movies and music to SELL, and make a Profit off of, then that's one thing, But, for personal use? completely different, IMO
