Thats annoying. If I was the seller, I would also be annoyed that an offer came in and I didn't hear about it for two days because my agent was in a seminar. The seminar can't be 24 hours a day, he/she should be checking messages and handling offers during break times or before/after the seminar.
RIGHT SAID FRED! Being a seller, and how pins & needly i get when someone comes to the house and i didn't know that there was an offer two days ago... nuh-uh! no way. i'd be ****** and let it show in the amt of commission i pay!

IMHO, the agent probably already presented the offer and the seller is trying to buy some time without answering you.
DH and I did the same exact thing. We were NOT happy with the offer we received, which was phrased as "non-negotiable", so our agent told their agent that she was working on reaching us for a couple days.

that is more understandable.
I mean, my husband and I are both cool about it...we are just going about our lives...but IF what you are saying is the case, I think that is pretty weak.

Good luck on the offer! When we submitted offers (like 10 of them) there were times we didn't hear for a day or two... in NJ I think there is a time limit.
I wouldn't be surprised though if they were "using that excuse" to buy a little more time.
I know in one example we offered before a Sunday open and of course didn't hear back till the day after the open.
You never know with this stuff...

Update #2:
the sellers countered, over our price by about $35 k.
there is only 3 titled transfers comparable to this home within the last 3 years.
ALL of them sold for less than this house.
and all of them were updated.
the comp MOST like this house was completely updated in 2005 (roof, bathrooms, kitchen, windows etc) and sold in 2006 (when the market is still better for sellers) for $21k LESS than what they are asking us to pay for a home that has not been updated since 1987.
at all. not one bit.
this should be fun. I don't think they are going to come down to our level. and there is no way the house is worth what they are asking.

If you truly don't want to go up anymore, I would have your realtor tell them that that was your best offer based upon the comps and the new information on the age of the roof, etc.
I tell this story all the time, but one house we offered on...they countered and it wasn't working. We said, this was our best, and that was it. Two weeks later they called and would have taken the original offer (realizing it was the best they could do).
We ended up not taking it (thank goodness) but its how the system works.

They're nuts! Don't give up! Tell them you're not going up by much and give your comps findings and thats it...with so much to be done and a 19 year old roof they're crazy!
Have fun with this though! It seems like you guys are cool about it which is great! Keep us posted!

since there was some interest in the saga
we went back at $7k above our first bid, $24 k below their counter.
we will be waiting for the inspection to ask for the roof to be taken care of.
my agent will also be asking the sellers agent to share her comps. and we will be building our case with hours.
ETA: the agent agreed to share her comps with my agent, and she said she'd review OURS before going back to the seller with the offer.

this directly relates to my update...and what we are hoping
UPDATE #4: we sent the agent our comps and she has neither responded NOR has she sent over the comps SHE used to price the house.
my agent thinks she just priced the house at what the owners wanted (w/o doing the research) and is now backtracking.
NOW I am KICKING myself for not insisting she look at the comps BEFORE raising our bid...but methinks we can revist that price AFTER the inspection on Sunday.
we'll see what happens today.
In any event, I've already started looking up more homes that could interest us. This isn't the only house on the block!

Some people have unreaistic views of their house and don't care what comps are. To them, their house is worth whatever it is they are asking, and unless they are desperate to selll will stick to that asking price. Some people are oblivious to the fact that the housing market is down and think they can still get 2005 prices.
Hopefully your sellers are not these kind of people!

Zillow's estimate is 250,000 k. almost 100,000 less than the asking price (and honestly, probably closer to the real value than the asking price is.)

I wouldn't bang TOO much into the Zillow estimate. Its helpful but it doesn't have all the information it needs (unless you've plugged in all the details, have you?).
So, I'm totally wrapped up in your updates...why are you doing the inspection before agreeing to an initial price? If they come back to you tomorrow and say "no go, we are firm" then you won't continue, will you?

I have a crazy long list of properties I was going through today. gave them over to my dh to weed through to find a few we both like.
they countered at 325k and the agent sent us the comps.
I will except from the email I sent to the agent comparing the comps to our house:
You know, after viewing all of these homes I am even more confused. I will go through each listing in order and give you my thoughts about why they are different...some so much so that I can't believe they are actually "comps"...and as a buyer, these are my thoughts about them, I just used MLS numbers to protect the innocent 411026 SOLD Price 315,000 (10k LOWER than the seller is now asking for) lovely home, approx 700 square feet LARGER than 651, electric updated, new oil tank, 2 FULL baths, hardwoods under carpet. Just given the SIZE difference, I wouldn't compare the 2 and I doubt a bank would. at the same price per square foot, 651 scotchtown would be about 80k LESS (given all else was equal, which it's not) 423883 SOLD Price 329,900 (currently 4 k more than sellers counter) barn has converted cottage. upgraded kitchen baths, windows, furnace oil tank ROOF. heated workshop. they put the work in. how can 651 command a similar price with NONE of the upgrades? 442588 SOLD Price 345,000 (20 k more than sellers counter) this is a new construction. is it a true comp? that notwithstanding, kitchen is new, master suite, almost 400 sq ft larger, new hardwood floors, new roof, new well pump. I keep using the word NEW. it's a theme.
SOLD Price 330,000 (currently 5k more than sellers counter) a sort of neighbor. also a newer home. renovated kitchen, home warranty, 2 baths, extra finished square footage in basement. this is really no where near the same kind of home in my opinion. but the kitchen renovation alone jacks up the price over what 651 could command. 405529 SOLD Price 355,000 (currently 30 k more than sellers counter) where to begin here. BEAUTIFUL home. 5 acres, 600 sq ft larger, hardwood floors, renovated in 1996. as lovely as this house is, they dropped their asking price 79K! it has 3 fulls baths and 1 half. it's more different than it is similar to 651. 428934 SOLD Price 325,000 (currently same as sellers counter) main difference is in the size- 650 sq ft. larger. also has hardwood floors and looks more updated. would need more info to do an in depth comparison, but I'd like for someone to tell me why we should pay the same price for 1/3 LESS house. 432443 SOLD Price 392,000 (currently 67k more than sellers counter) another stunner. beautiful home. 700 sq.ft larger than 651. COMPLETE renovation in 2007- New Roof, New septic, New well Pump, New boiler & Central A/C, New state-of-the-art kitchen, Fabulous New Family Room/Master Suite Addition with Whirlpool tub, and more. and in spite of all of these additions/upgrades, they sold for 82k UNDER their list price. 434279 SOLD Price 345,000 (currently 20k more than sellers counter) this home is slightly larger and has potential rental income. kitchen is newer. it has a swimming pool, koi ponds, waterfalls and gazebos. .Roof=2002, Siding=2003, Kitchen=2005, new garage flr & new garage door and floor.. 429441 SOLD Price (335,000 10k more than sellers counter) this is a fairly newer hom (1950) about 200 sq ft larger, 5 bedrooms 2 FULL baths, renovated...kitchen etc, has a pool and an hot tub sauna on the property revnoted in 2003. is also natural gas and municipal sewer, which are bigger than good schools to us. 412251 SOLD Price 325,000 (currently same as sellers counter) house was completely renovated in 2007. also natural gas and municipal sewer. so that is the end of them. Overall they are all lovely homes. And I think that IF the 651 home had some of these more recent upgrades, we would agree with the price they were asking. But they don't. to me, it's common sense, just looking at them. I feel like some of these comps are way off the mark. And it is my big fear that the banks will agree. I was very open to the possibility of being shown that the house commands the price they are asking. WE like the house. We think it's lovely. We adore the land it is on. But we'd have to take on MANY of the projects the buyers of the above homes had completed for them by their sellers. It just doesn't make sense for us to pay near or about the same amount for a home that just doesn't measure up. I understand that this home hasn't been on the market very long and the sellers want to get the best deal. Who doesn't? We happen to be in a position where we are not in a rush to move for any reason, so if they don't want to go forward and take their chances in this market, that is up to them. Since these comps have failed to convince me of anything (other than how right I am LOL) I don't really see us going up much further from our last offer, if at all. I really feel like the comps we are going by are closer to the mark. These are solely my thoughts about everything as dh is asleep. I am fairly sure that he would agree with me though. I'd like to talk to him in the morning before making a final decision about a counter, but feel freei, to share my thoughts about these comps with the sellers agent or even the sellers themselves. You know how much we like the house. we know how much we like it. but we are determined to use our heads as much as our hearts in this matter. And using my head tells me not to spend top dollar on a 20 year old kitchen and roof.
