How long did it take you from 1st accepted to contracts signed?
I know everyones situation is different - we signed our half of the contracts as the buyers 3 weeks ago today and left our entire down payment- the sellers have every excuse in the book as to why they havent signed yet (mostly their REA being a PITA) - It was so exciting and it is becoming more of a disappointment that 3 weeks later new issues still keep coming up. Such as we had the home appraised and then they 'werent sure if they wanted to sell to us even if the house appraised fine since we are first time home buyers' - then we wanted a sellers concession - they were fine with it as long as it goes thru with the mortgage company, our mortgage broker and attorney are bending over backwards and they get the appraisal DONE to get it approved, SENT the mortgage to the UNDERWRITER to make sure the mortgage would get approved and NOW after ALL OF THAT IS DONE - they want to talk about the fee that they may be responsible for with grieving their taxes - fine NO problem - but up until this day - when DH or I email the sellers realtor (by way of fake email account) she is telling us that the home is still available and can be shown.......

realtors always do that until the contract is signed. some will even do it after the contract is signed.
i am sorry your sellers are being so difficult. if it's meant to be, it'll be worth the wait and heartache!

We accepted an offer on monday (I think), the inspection was Thursay. the buyers only signed their part of the contract today (one full week after the inspection). And who knows when we will sign since its a holiday weekend - I'm guessing not until tuesday or wednesday of next week.

You gave them your WHOLE down payment... And 3 weeks later no signed contract.. Do you hve an attorney. It shoudnt take sellers NO more than 7-10 days to sign.. You need to get your attorney INVOLVED.. And whats your agent doing twiddling their thumbs.. Thats absurd...

The whole downpayment was given to our attorney - apparently its the sellers REA that is finding new road blocks to constantly throw up - we both want this house - but its become such a headache that even if we did want to continue the search - if we go with something else - all of our downpayment is tied up for who knows how long...

Do you know if they cashed the check yet? Ask your lawyer if their lawyer is allowed to cash the check without having the Seller sign the contract. It seems to me that they would have to do both around the same time. Maybe your money is not tied up after all - maybe you can stop payment on the check!

Your attorney should be involved, Im sorry. And a real esate agent doesnt have that much control if the seller really wants to sell... This happened to me I called the agent and told them I was reporting them to LIBOR and was contacting the town about false pratices. The town responded and low and behold everything came into play.
Dont sit ITS YOUR MONEY and your attorney should be demanding a signed contract or your money back..
Im really sorry In the future I dont care what an agent, your attorney or anyone else says you put down 5% of your downpayment not a penny more. Im not lecturing, I find it appaling when people play games with your hard earned money.
Check your contract does it say the sellers have 7-10 days to sign contract or all deals off? Sometimes they add this into contracts/..

I filed a complaint on this website with Nassau County, the do respond. You need to explain poor practices of the real estate and that you are getting no cooperation blah blah. And that you are worried about your down payment, you feel like you are being scammed.

I agree with the pp - they are playing games. They probably are trying to wait it out to see if they get any other/better offers... which is not right. Personally, I would tell them if the contract is mot signed by a certain date, you redact your offer and want your downpayment back so you also can move on.

when we put offers in i had asked how long and they told engineer (2-3 days) you need to get in, next day you get your report, then the next work day you get your lawyer and go into contract. 1 to 1 1/2 weeks tops.
They don't like your offer they are trying to field other offers your lawyer needs to get a commitment to closing otherwise you risk loosing the property if someone falls in love with it and outbids you. Then they will put you against the wall and say up your bid (after you spent the time to hire a lawyer, pay for engineer.)

Absolutely, if the house is still on mlsli call the agent and make believe you are interested in the house and see if they will show it to you, then you they are playing games...
