HR Question Re Firing....HELP!
My husband has worked for a financial co. for 9 years. He was just fired for insubordination. It is a ridiculous claim but our theory is that they do not want to pay him the fairly large severance package he would be due so pulled this to get them out of it. They did offer him a package worth half of what it should be. They did not give him any solid evidence as to what incidents they are claiming took place. that led to the firing and there was no formal warning.
Here is my question...is this something he can try to negotiate with Hr directly as opposed to going to a lawyer. We honestly do NOT want to turn this into a big ugly thing and just want him to get what is due him. They gave him the offer paperwork and he has 10 days to respond. We are just not sure if they would take him seriuosly if he tried to talk to them himself. Can they retract the offer if they get annoyed with him for trying to negotiate? He has so much on this company after years of abuse but we really do not want to go there.

if he was truly fired for cause, there is no way a financial company would offer any package.
I would demand to see, in writing, what specific insubordinate issues occured (dates, times, etc). especially if he wasnt on warning.

I am not sure if they can retract the offer, but they are trying to save $$ by not giving him a full package (laying him off).
I would think he could go back to HR and negotiate without a lawyer first. If they don't want to show him proof of insurbordination, then I would lawyer up!

From my experience, he can go to HR and try to negotiate first because HR wants to do anything they can to avoid any type of litigation!

ITA.
He can ask to see his personnel file which will be the first red flag that they'll have to negotiate.
They are only required to give him copies of stuff he has signed but could always give him more. Does he have copies of positive reviews?

Thank you so much for your responses and support.
The HR person was quick to say in the meeting that "they don't have to give him anything" since he was being fired. But you are so right....just by them offering him some sort of package is proof that they are trying to shut him up because they know they are in the wrong.
I am going to have him call his hr rep tomorrow. He was not sure if he should calll or have a lawyer do it and it seems like he should as a first step. No he does not have copies of his reviews unfortunately.... but I will have him ask for that as well his file and copies of whatever "incident" they claim to have. I will let you know how it goes after that because I am sure I will have more questions. THANK YOU AGAIN EVERYONE!!!
