If I keep having problems with this car, can I legally tell them it's a lemon and trade it back in for another new car??!

did the light come on after you recently got gas? It could be a loose gas cap.

But yes, you shouldnt have to pay for anything and if you bring it to the shop again, you can build a case and have them take it back.

its at the dealer's shop right?

everyone keeps asking me this. this must be a common reason that the engine light goes on. i haven't even had it long enough to get gas!!! but, I did open it up and tighten the gas cap to be sure....the engine light was still on Chat Icon

let me know why the engine light came on when they tell you. ill let you know if its worthy of bringing up a case in which it would be a lemon.

I worked in the accounting pasrt of a dealership for 3 years so i have many friends there that can explain to me what you can do

NY LEMON LAW

This may help, although it is a little ambiguous. Hopefully it is something simple that they could fix this first time.

Re: I should have listened to the general consensus. Got my NEW VW Passat last Thursday and it is already in the shop!!!

I went through alot with my VW. It is very hard to prove the Lemon Law. They also had me sign something when I bought it regarding the LL, so it was difficult for me to fight them on this. I had the same issue, as did my cousin, drive it off the lot and the engine light never went off. Then I would have it fixed, the light would stay off for an HOUR and then back on again. I ended up threatening to sue the dealership b/c due to a variety of issues. 3 months later, I got my money back and took it to a different car dealership. No more VW for me. I had my car for a total of 3 months, most of it, the car spent at VW, hence the cars nickname FUKENBROKEN!!!

Good luck. Don't let them take advantage of you. Make sure they fix it and guarantee it!!!

How long have you had it? I just had my engine light come on on my Acura and it was 3 days since I had gotten gas. I tightened the gas cap which was loose and it took another 2 days for the light to turn off.

I also freaked with my Passat when the light came on and it was the gas cap.

Hopefully you just had some moron who can't screw on a gas cap.

I think for the Lemon Law you have to have the same problem three times...and its hard to proove...but VW is pretty good about fixing things...Hope everything works out!

If you bought the car from a dealership, you can usually return the car w/in a certain time period. I believe it may be 30 days.

A friend of mine did the lemon law. They kept giving her new cars before they would do the lemon law for her, though. I hope it works out. Let us know!

We had friends use the lemon law for a land rover - but it is a LONG process.

My BIL had a VW and said the engine light was a VW issue, but it was nothing to worry about (although now you can't pass inspection with it)

also - you have to go about 100 miles, before the light goes off with the gass cap.

That's totally f'd up! Please let us know what happens... That's incredible that it's happening on a brand new car. If it was a used car, you might wonder what the previous owner did to it. But you pay 20k+ for a car, you expect it to be PERFECT!

Please tell me they gave you a loaner. They are required to if your car is going to be in the shop longer than 24 hours and it's a warranty repair, I believe.

And yes, see about getting a different car with a different VIN or returning it altogether.

Sorry this is happening to you! Chat Icon

Re: I should have listened to the general consensus. Got my NEW VW Passat last Thursday and it is already in the shop!!!

By the way, I think there is a specific light for the loose gas cap. I know there is on my '04 Passat - it came on once and as soon as I tightened it, the light went off.

I would have freaked too if the engine light came on, loose gas cap or not.

Re: I should have listened to the general consensus. Got my NEW VW Passat last Thursday and it is already in the shop!!!

MIL lights have a "3 good trip rule"

so say your gas cap is loose, the light goes on, you fix teh gas cap, you need to take 3 "good" trips in the car (good as in gas cap closed) for the light to turn off.

My car is at the dealership now and they can't replicte halfpf the problems and I am in the hole over $700 Chat Icon

ETA: I wouldn;t pnic or get angry, the engine light is usually nothing

Re: I should have listened to the general consensus. Got my NEW VW Passat last Thursday and it is already in the shop!!!

I had a new Jetta. My engine light had nothing to do with the gas cap. The VW dealership didn't know why the light wouldn't go off, they said it was ok....whatever. A brand new car should not have the check engine light on constantly. How would I know when I really needed to check the engine????? Oh thats right, when the car siezed at the gas station and I had to go to the VW dealership, pick up a mechanic, bring him to the car and he had to start it for me using this strange way of turning the key and shifting the car from P to D. Mind you this could only be done with my left hand, as my right hand had to jimmy the ignition!!!! That wasn't hte only issue with my car, that was just the first.... Chat Icon

It has nothing to do with the VW...it has to do with german engineering! I know ppl with BMW, Audi, Mercedes and VW...most of them have had major issues with the "Check Engine" light.

My dh's first VW had that issue within the first 24 hours, the dealer gave him a new one and knock on wood no further issues.
