andno i'm no pregnant, just wondering...but do you have to take days in your bank or can you just take a leave for a few weeks?

I am not sure if you are required to use your banked days- you are entitled to 12 weeks of FMLA no matter what.
I took maternity leave last year, and used my days, which also ran concurrent with my FMLA time. I don't recall that not using them was presented as an option, but frankly the whole process was confusing- even my payroll secretary seemed confused by certain aspects of it. If you have a knowledgeable payroll person, s/he would know.

when i went out on maternity leave i didn't use the days in my bank. i wanted to have them just in case when i went back if i would need to take a day here and there. i took an upaid leave of absence and went back to work after 3 months.

I don't know about NYC, but in my district it's 12 weeks for FMLA and then you can use sick days for additional time.

if you're tenured, you can take a year off (or more, but you must apply again and it may or may not be approved), not paid, but your job is held.

It depends on your district and union contract. In my district, you have to use the days in your bank for your 6 or 8 weeks of paid leave. you can take the 12 weeks of FMLA but you dont get paid for all of them but it doesn't affect your seniority or position. After the 12 weeks you are still on unpaid leave and your seniority is affected.

Same here. In my district you use your days concurrent with FMLA. Most women run out of sick days before FMLA runs out.

Tenured teachers, same as above. If you give birth January to June that time doesn't count towards one of the years.

In theory, because I gave birth March 07, that March through June didn't count as a year. I COULD take off Sept 07-June 08 AND Sept 08-June 09. I would have to go back June 09 or resign from my job.

For my district it is per birth, not per child. I found out in other district I could take 4 years off for having two at the same time. I could only do that if I had them separately in my district.

ETA: Seniority is affected by leave.

wow that is great that a birth between Jan - June doesn't count as a year. Does that count against your seniority?

Not sure if you can just leave in my district...we get 6 or 8 weeks where we have to use our sick time. Then we can choose to go out on unpaid leave.

In my district it does count towards the time you take off. So if I had my child in Jan 07, if I didn't come back by Jan 09 I would have to resign IF the district let me take the Sept 08-Jan 09. In our district the school board and staffing have the final say.

As for seniority that is effected by the time. In our next to the persons name it will say (x weeks) that means how many they are out. I now have more seniority than a girl in my department who had been there for 3 years before me because she has had 3 children. For me however, I was only off payroll for one pay cycle with my dd so I only lost 2 weeks of seniority and if this one goes as planned I will not be off payroll so I will not lose any seniority.

All of this for me is on LI district.

FMLA and sick time do not run concurrently in my district. You can also take up to 2 years per pregnancy.
