LI teacher maternity leave question

Hey Teacher Ladies,

Have any of you out there had or are about to have a baby over summer vacation?
I am a teacher in a public LI school district. I am due in early august. My district is telling me that my paid time (sick days...6 weeks worth) will start being deducted from the day of my baby's birth. Which means once the school year starts I will be left with almost no sick days or paid time.
Any additional time I may take off after that will be unpaid and will be deducted from my senority in the district.
This seems so unfair to me! Had anyone else ever been deducted sick days over summer vacation?

Thanks in advance!

Re: LI teacher maternity leave question

Something isn't right...it should only be deducted for days that you would be AT WORK. Since you aren't at work in August that shouldnt be. Contact your union rep and HR>

WHAT??? Do you get paid over the summer? But that still wouldn't make sense!
Do you know anyone in your school that had a baby in the summer that you can call?
That doesn't even make sense! Chat Icon

Re: LI teacher maternity leave question

My school district is the same. I just had my baby boy on July 14th via c-section so I get 8 weeks but that takes me exactly to the start of the school year so I have to either go back to work on the first day or I can take FMLA leave but I won't be paid and would have to pay my contribution for my insurance. It works this way because it our contracct it states that your paid leave begins on the date of the child's birth. It really stinks. My husband and I are trying to figure out if we can afford for me to stay home for September...I'm really hoping I can!!!!

I don't think that they will deduct your sick days until school starts. However, the allotted 6 weeks ( depending om your dr) that you are given through fmla starts when lo is born.

I see it as a plus. You will still have so much od your saved sick time left. Jmo

I answered your other thread:

My leave starts on 9/6 (1.5 weeks after DD) and I get 6 weeks paid through sick and up to 6 more unpaid FMLA - then it goes on a semester basis.

I am a NYC teacher but had the same question bc my due date is 11/17 so i might run into Christmas Vaca. Anyway, I totally agree that it woiuld count towards your 6 weeks. However, they should NOT be deducting your days!! So, if I am on leave during Christmas break that would count towards my 6 but those days would not be deducted from my bank bc school is not in session. I would def. call yoiur union rep. and HR.

Your sick days are not used until school is in session.... however, your 6 weeks leave starts the day of the baby's birth.

I had my DD July 9th. The leave does begin on the day of your childs birth however, you will not have any days deducted from your sick leave bank. The 40 days begin on the birthday but since it is over the summer, they are not deducted. What I did was I took the FMLA (12 weeks unpaid, but I had my insurance through my DH so I did not have to pay anything). We switched to his that year for that purpose. I did not have to return until the Monday after Thanksgiving. If you can make it work, try to stay home!!

Re: LI teacher maternity leave question

I work in the city and it is similar. They do NOT deduct your days though your paid leave ends 6 weeks (8 weeks c section) from babys birthday. If baby is born in summer or any other time when you are not working sick days are not touched since you are NOT supposed to be work anyway. I would check that part out.

FMLA covers health insurance for 12 weeks, FYI Chat Icon
