Looks like the deal may end up being over ...

Well, we have signed the contract and put down a sizable deposit, but the home owners have not signed. Today, I find out that they refuse to furnish a CO for inground pool in the backyard, meaning that their taxes are not legit, and would go up like 1500-2000 dollars. Plus, we would have to get the CO ourselves, which could be expensive, but I don't know aything about that. Also, they don't want to move until September (our closing date is currently July 15th) and I am a neurotic teacher who cannot multitask very well at all! I was hoping to move in over the summer so we can unpack and do some work on the house while DH is on vacation from work and I am off for the summer. Theses people have been giving us a headache since day 1 and I don't think I want to be bothered with their b.s. any more! What would you all do?

First, I'm really sorry to hear about your problems.

I would tell your attorney that you are concerned about the CO, and you want to be in by the closing date or the deal is off. That may motivate the sellers to resolve these things, though the CO can take a long time to get processed. Does your contract have a timeframe for the closing? After a certain point if the closing date is not honored, you can usually back out of the deal with your deposit intact.

I don't think you should try to take on the CO yourselves. There is one for the house we are buying also, and despite what our attorney said, we found most lenders will refuse to go forth if there is an open CO, so you may not be able to get your mortgage. In North Hempstead, we found it takes an average of 8 wks. to get these processed (the one for our house has been sitting for 6 wks.)

Again, I am so sorry! If you need to look all over again, there should still be a lot available. Sales have been slow this spring from what I've read.Chat Icon Chat Icon Chat Icon

I'd always be ready to walk away. There are many other houses out there. The pool CO sounds like a deal breaker, unfortunately, to me.
