Loosing my job - question at bottom about the negotiation.
You don't lose your right to unemployment. The paper you sign is basically saying you will not file an employment claim.
They don't pay unemployment if you file. Companies pay into unemployment fund while you are working for them. So if you file or not does not affect them. Unemployment office will not let you collect until your 4 months are over. They consider it almost like you are working cause you got 4 months salary.

If you get a lump sum payment, you can collect unemployment after a week. i.e. If you get paid 4 months or $40,000 at the time you sign the agreement, you don't have to wait for the 4 months the 40k was supposed to represent.
I had to terminate a few people at my last job and I did the unemployment paperwork. They always asked when the last payment was made, not what it represented.
If I were you, I would ask for 4 months severance pay and stop working. In this case you could collect unemployment while looking for a job on top of getting the 4 months of pay upfront.

I believe NYS recently changed this. Even if it is a lump sum they will make you wait to collect benefits.

I didn't realize they changed it. In DC last year, you could still collect one week after.
