A Manhattan man is feeling flush with anger after he says he was forced to sit in the bathroom for three hours on a cross-country JetBlue flight.

Gokhan Mutlu is now suing the airline for $2 million for having "mortified, disgraced, degraded and shamed" him by confining him to the can.

Mutlu says the bizarre incident happened Feb. 23, when he was a standby passenger for a flight from San Diego to New York.

He was told the flight was full because a flight attendant was taking the last available seat, but was then told she would sit in the "jump seat" and he could have her seat, 2E, the suit says.

He was issued a boarding pass and took the seat, but got a rude awakening as he began to doze off about 90 minutes into the flight.

That's when the pilot called him "towards the front of the plane, towards the cockpit, and advised the plaintiff that he would have to give his seat up" to the flight attendant, the suit says.

"The plaintiff was puzzled and asked what was going on," the filing says.

The pilot told him the "flight attendant wanted to be more comfortable and that the 'jump seat' was not comfortable for her."

Mutlu "asked if he was being directed to surrender the seat issued to him and to take the 'jump seat' for the remaining part of the flight, which was about 3 ½ hours."

The pilot told him the jump seat was for "for personnel only," the suit says.

"Even more puzzled and perplexed, the plaintiff asked if the pilot was directing him to stand for the remaining part of the flight," it says.

The pilot said no - Mutlu should just "go and 'hang out' in the bathroom," the suit says. In the meantime, the stewardess took Mutlu's seat, "closed her eyes and pretended to sleep."

When Mutlu began to argue, the pilot "became angry at the plaintiff's reluctance to go . . . to take his place in the rest room and took a much harsher tone with the plaintiff, advising him that he was the pilot, that this was his plane, under his command, and that the plaintiff should be grateful for being onboard," the suit says.

Mutlu says he was "imprisoned" in the bathroom for hours, which "seemed like an eternity."

He was ordered back to his seat when the plane ran into heavy turbulence, the suit says.

"Plaintiff walked back to his seat embarrassed, humiliated, mortified, disgraced degraded and still shocked beyond belief," and tried "to cover his face" as he walked up the aisle, the papers say.

The flight landed at JFK around 5:30 am, and the pilot stopped him as he was walking out "and asked if everything was okay. The plaintiff replied, 'No,'" the suit says. The suit seeks money for emotional damages.

A rep for JetBlue said the company doesn't comment on pending litigation.



Doesn't seem possible that this would happen, but if it did, I definitely think this warrants a lawsuit. Health reasons, safety reasons (no seatbelts), emotional reasons, etc. Chat Icon Chat Icon Chat Icon

I agree. It's very hard to believe! I'd like to hear what others on that flight heard/saw.

so do I....NEVER would a flight attendant tell a passenger to get out of a seat so they could sit in it.

I can pretty much guarantee this is totally false. That pilot would lose his license as it is against federal law for someone to be at the front of the plane with a pilot out of the cockpit. There are certain procedures that MUST be performed when any pilot leaves the flight deck, one of them being that all passengers must be seated.

Additionally, no flight attendant in this day would risk HIS/HER job by choosing her/another crewmembers personal comfort over a paying customer.

It sucked having to ride the jumpseat on long flights, but at least it got me to where I was going for free...... I would have NEVER (nor allowed another crewmember) done what this man claims was done.

If the pilot said this, he would have had to have said it over the PA system on the plane. If he did, EVERYONE would have heard it. I find this hard to believe.

There would HAVE to be witnesses. The pilot is not allowed to leave the LOCKED cockpit. He's have to say it over the PA system, unless they made him get up and use the crew phone. And if anyone even tried to suggest it to me I would have made such a stink about it you bet there would be witnesses!

Sorry, dont beleive it.
I was recently just on a Jet Blue flight. On our flight, Our tv didnt work, Credit towards another flight was given. I didnt even care about that.

On way home, flight delayed 2 hrs. Another credit given for that.

Jet Blue is all about service and I highly doubt that would even happen!!!

My dad flies standby all the time with them.....works for JFK, and they would NEVER offer a seat like that.

I love flying JetBlue and I don't see this happening. I also agree. There has to be witnesses. Why would the pilot risk losing his license? Something is just not right with the whole story.

Actually, that part I wouldn't question too much. I know a lot of people that will blindly listen to what a person in "authority" says. A lot of people WILL do what a pilot/cop/fireman/etc says, even if it makes absolutely no sense, and seems dangerous, even.

I *do* question the whole incident with the pilot and flight attendant doing the actions that the lawsuit says. THAT part I can't believe.....

My cousin works for jet blue, I'll have to see if she knows anything about this (she works out of Vegas, but knows many flight attendants that work out of california)

On a side note- she ALWAYS sits in the jump seat when flying home (to NY) to visit, unless the flight is not full, most of the time it is though, because she visits during holidays.
