Maternity Leave ???
I am due Jan 22nd. While on maternity leave is the Feb break. Does that count as one of my weeks out? School is closed anyway so do I have to use my time for it?

in my district, maternity leave over a holiday only counts when it's a full week (mon-fri) off

Doesn't count in my district.
They do 60 school days as their interpretation of FMLA. Same with the "6 weeks" maternity leave, it's 30 consecutive school days.

Same for us. If you are taking FMLA,the vaca will not count.

Every district should have the same rules reagrding FMLA and school vacations of 1 week or more. Schools breaks of at least 1 week do not count towards the 12 weeks of FMLA.
From the FMLA regulations (825.200):
For purposes of determining the amount of leave used by an employee, the fact that a holiday may occur within the week taken as FMLA leave has no effect; the week is counted as a week of FMLA leave. However, if for some reason the employer's business activity has temporarily ceased and employees generally are not expected to report for work for one or more weeks (e.g., a school closing two weeks for the Christmas/New Year holiday or the summer vacation or an employer closing the plant for retooling or repairs), the days the employer's activities have ceased do not count against the employee's FMLA leave entitlement.

in the city you get 6 weeks maternity in which you use your own days. yes thats right you have to use your days within that first 6 weeks. If you dont have the number of days to get you through to the 6 week mark you can borrow up to 20 days. Then you can also take FMLA leave . I did 6 weeks paid and had to borrow 11 days to get me to that point and then 6 weeks not paid. BUT.. i fond out the hard way that your summer pay is affected bc you didnt work the entire 10 months and went off payroll. they get ya coming and going i swear!!!!

I was surprised to find out that even though I have 52 days in my CAR that I could only get paid for 6 weeks worth. The NYCBOE is so crazy.
You fill out the OP198 to get the six weeks pai,d right? Do you know when you fill it out? Also do you then fill out the OP160 if you want to take a leave of absence? TIA

In my district, we use our sick time as our 6 weeks maternity leave. I will be out on maternity leave (using my 6 weeks, not FMLA) during Feb. break and will have to use my sick time for that week, but will get the sick days back when I return to work.

I have close to 50 in my CAR as well. You can only use six weeks work and then you go unpaid even though you have the days in your bank?? That stinks! And then they take pay away from you for the summer!!
