Maternity Leave
I do not qualify for FMLA, I work for a very small company and I think i'm the first one to ever be preggo here so I don't even they even have a maternity policy lol. I signed up for Afflack eff August 1 but they said I wouldn't be eligible if I gave birth before 10 months which looks like what is going to happen. Is there anything else out there that can help me or do I just have to only get my 2 weeks paid vacation and suck up the rest?

Wouldn't you be eligible for NY State disability?
I think if you job doesn't cover you 100% yopu get 6/8 weeks at $170

you should be able to get the disability through NYS. its something..not much but better than no pay at all.

As I understand it, FMLA is a totally seperate issue from disability - it only would gaurentee you your job for up to 12 weeks but no pay.
Disability, I believe depends on what type of poilcy your employer carries - if any. I think if you have disability taken from your paycheck, then you should get something. My employer only has the NYS insurance fund disability which shakes out to about $170-taxes a week but it seems some companies have policies with other carriers that get them more.

Correct, FMLA just gets you 12 weeks off, no money involved.
NY gives 6 weeks for vag birth/8 for c-sect
My employer gives us 100% pay while on disability for a certain number fo weeks. I play on being out 4-5 months between our leave, fmla, vacation, etc

I don't know if my employer carries any diability. The only deductions are FICA, FED WT and NY ST? Sorry if i sound stupid I just know nothing about this stuff and we don't even have an HR person to go to. I would probably have to talk to my boss about this. I wasn't planning on doing it this soon though

I would talk to your boss about it - but honestly, at this point it's not going to change so if you weren't planning on saying anything to him for a while, I would probably just wait.
It sounds like maybe they don't carry disability - if it was on your last years W-2 I believe it shows up in box 12 or 14 (I'm not sure though) so if there is nothing there, I don't know if you can collect anything. But when you are ready, you can ask your boss. My boss was pretty clueless about the whole thing - I work for a fairly small company and I don't know that he has had to deal with this ever either but he did tell me he thought I had to fill out a form.

Your welcome. And I was just looking at that site - I THINK it is saying that a company with more then 1 employee must provide the NYS disability - so you probably should get at least that.
