Maternity Leave/Work Issue

Hi everyone.

I don't post here much, but I've come across a problem at work and need some advise.

I just returned to work from maternity leave on Monday, and on Tuesday, my boss said the following:

"Since you had a baby, you'll have less responsibilty." After he said this, he realized what he had said and back pedaled.

They hired a new supervisor for me that will be doing my work for more money. They are changing my job description, but are not changing my title or decreasing my salary. Can they get away with this?

Yes, FMLA guarantees a job at the same level/salary but not necessarily the same duties. BUT it was not appropriate to infer that you are not capable of doing your job b/c you have a baby.

I agree with all of this and I might even address it with the new supervisor

I agree...they should've at least given you a chance to prove that being a mother wouldn't affect your dedication to your job.

ITA with everyone else your boss should of waited to see if you could handle your normal work with having a child. No reason to jump to conclusions but in the end it might be best for you.

Chat Icon Yes, they can. My company did something similar to someone, but she was HORRIBLE at what she was doing. She was also offered a more senior position but she turned that one down.

yup. I agree they should have handled it better, but its perfectly legal.

It's not acceptable and can be construed as discrimination.

I would contact HR immediately and address it. Your boss needs to get trained in discrimination policies asap!

While your boss shouldn't have said what he did (totally discriminatory).

The rest falls though within the FMLA guidelines.

My job function completely changed while I was out on maternity leave. I came back to an entirely new position, new responsibilites and a job function I was totally unfamiliar with. However, because it was a "like" job to what I had, they were allowed to do this.

This is totally legal as there was no change in job title, level or salary
