Maternity question for NON nyc teachers
Let's say you deliver in mid-June, and you want to use 12 weeks, can you take the last 2 weeks of the year off and the remaining weeks beginning in sept?
i know some schools have different policies...just trying to get an idea if anyone has done this or know someone who has

I am upstate and in my district, I am not held to 12 weeks. I just use whatever sick days I have accrued and then have to take unpaid time. I can take off up to 1 year and still retain my position.

I believe my 12 weeks would begin the day I delivered/went out on leave, so I would have 2ish weeks left once the new school year began in September. I can't defer my leave to begin later than my delivery date.

Yes. For us it would count toward my FMLA time. Past 12 weeks would be child rearing, but I can't be paid for that at all, and I can only come back from that in September and February.

This is exactly what I did with both of my babies. One was born 7/6 and the other 6/27. (different years obviously... haha!) I took most of June off with both of them. I was just tired and had the sick days to get me through the month anyway, so why not? ;)
Then, I had my summer off and THEN i was able to use my 12 weeks beginning in September. (I returned after Thanksgiving). HOWEVER, even though I still had sick days left in my bank, my district would not let me use them in September to pay for part of the 12 weeks. By that point, the 6-8 week recovery period had passed and so I was no longer "sick." they gave me the 12 weeks but it was completely unpaid. I also did not accrue seniority during that time.
i think every district has a different contract, so i would really talk to someone in your union about the policy.

I had to use 6 weeks of sick days and the rest was unpaid. I had a c-section, but still only could use 6 weeks sick days.

Same here...my DC was born mid-July
I'm pretty sure this is how my district works it. It's up to the district to decide if the 60 days are school days or not I think. However, after your 6 or 8 weeks are up you can't use sick days unless you have a doctor's note with a reason stating why you're not yet cleared to work.

The 6 or 8 weeks paid "clock" and the 12 week FMLA "clock" are two different things.
My son was born in August. The six week paid clock starting ticking the day he was born, no matter when the child is born. So I did get paid for about two weeks once school opened, as I did not return until February.
However, according to people I have spoken with, FMLA 12 weeks can not start if school is closed. So my FMLA clock did not start until school opened and that ran until around Thanksgiviing.
Hope that makes sense.

I had a June and May baby and my district let me do that...take off up to the summer break, then continue once the school year began again. With my first I took an extra year and with my second I took 2 years. It was great b/c with the summers as a *bonus*, I went back when one was 14 1/2m and the other will be 2y 3 1/2m.

Depends on the district. In my DH's district, the 12 weeks starts from the date of birth or your last day of work (so if you had to take a week off beforehand, that counts towards the 12-week leave).

The way it was explained to me: the 12 weeks you get are for recovery time, as is you were sick. You're only considered "sick" for 12 weeks after the baby's birth. So if you deliver in June, you can't claim to be "sick" for 2 weeks in June, then not sick for 2 months, and sick again in September. So you can't get paid for your sick days when you're not working (July and August) and you won't get paid in sept, when you're not sick anymore.
You will keep your health benefits for those 12 weeks Fter you deliver. And every district I know of will hold a job for you (not necessarily YOUR job, though, and you lose seniority while you're out) for up to 2 years.

This is the same way my district operates. A friend just had her baby June 30th; she will not return until the end of November when her "12 weeks" (from the start of school) are up since she worked to the end of the school year and gave birth after.
