NOT ME-Lawyers-divorce and custody question
Lets say a friend wanted to leave her husband and had a child. She wanted to move out of state-would that be a problem if it did not go through the courts for ex. if he did not fight it? So if one is legally separated can they move with their child? TIA

Do you mean the ex isn't objecting the move?
if not, I would get something in writing from the ex's lawyer and your friend's lawyer supporting her decision to move out of state with the child.
I would hate to move only to have to be served with papers to bring the child back.

I would hate to move only to have to be served with papers to bring the child back.
even if he is in agreement now, she should still get it in writing - he can always change his mind later and then say he never agreed to the move. is ee that happen all the time.
if he is not in agreement, i don't think she can leave without getting custody and permission from the court, because he can bring her back to NY for the custody case at any time - and if she just left with the kids, it looks REALLY bad.
