nyc child care leave
Hypothetical situation:
Say I was due to have a baby mid-June. My maternity leave and FMLA would both run out before the following school year starts. If I am untenured, can I extend my leave by a couple of months if I wanted to? Obviously it would be unpaid, but would I still have a job when I get back?
I am actually in my tenure year, so esentially I would be getting it as soon as I went back to work.

i am no longer in NYC so i don't know for sure, but you are not working in the summer anyway so i would think that would not count towards your FMLA.
I had my DD on July 6th.... in my district, my 12 weeks started the tuesday, sept. 8th. i do not go back until after Thanksgiving. in your case, i would think you would say use three weeks in June, then you would have about 9 weeks starting in September. Does that make sense?
your summer vacation is your summer vacation. you're not working anyway, so why would it count?
ETA: in my district, your tenure date is just pushed back the 12 weeks.

If you are due mid June then you wouldn't run out of leave time. For maternity leave you are given 6 weeks for vag. delivery, 8 weeks for c-section, BUT because the time would run into the summer you aren't penalized for that time. You could continue your leave through FMLA come September, less the number of weeks you take for the birth of the baby in June.
Hypothetically speaking, let's say that you work up until the day you deliver, and that day is June 1st, and it's a Monday. You would use the sick days in your bank (or borrow days) because you want to remain on payroll** for the remaining WORK DAYS in June, then your summer vacation would start and you'd continue receiving your regular summer pay checks.
Because FMLA leave runs concurrent with maternity leave, you've used (let's say) 4 weeks of Family Leave. This leaves you with 8 unused weeks of UNPAID leave time in September.
You are entitled to up to 12 weeks Family Leave at any point in the year up until your child's 1st birthday, but because it runs concurrent with Maternity Leave, the number of weeks you take is deducted from the 12 weeks given. Once maternity leave ends (6 or 8 weeks depending on delivery) you maintain your benefits and a position similar to the one you currently hold upon return.
HTH! I don't know what borough you teach in, but the Queens UFT does an excellent Maternity Workshop that really helped clarify a lot of misconceptions for me!

Thank you so much for all the info. I plan on going to the UFT workshop when I get pregnant b/c you can't go if you are not. I am hoping that it happens this month, so that is why I was asking about June...

For child care it is up until your child is 4. It can be extended for every child you have in between that time. It goes by the age of the last child (until they are 4). I took leave 6 years ago when my second was born. When she was 2.5 I had my third baby. I then stayed out on leave and returned this September when he turned 4. If I would of had another baby I could have extended it based on the baby's age. There is no guarantee that you can go back to your old school, just the district.
