NYC DOE Maternity Leave Question
Hi ladies,
So I went today to a uft workshop about maternity leave and the fmla leave. They also said that if we were planning on taking the fmla after the 6 weeks that we would have to fill out a form-OP160. I was just wondering if anyone knew when to fill this out. If I am not due until the end of August do I have to fill it out now or after my 6 weeks or during the 6 weeks?

Not sure if this is helpful to you but I gave birth last July. I filled out my paperwork in June but it couldn't be processed until I had the birth cert. After my dd was born I faxed it to my payroll sec. and she faxed it to the DOE! Hope that helped!

I'm almost positive the OP-160 is the "see you in September" form. If you're taking the remainder of the school year, fill this out. If your not, don't. I filled out the bulk of the paperwork in advance, but couldn't complete it until DD was born. We got a note on hospital letterhead to send along with the forms. Once she was here, I faxed and mailed the forms to my payroll secretary, who forwarded them to the DOE.
eta: Just a tip: MAKE COPIES!! The DOE Leaves Dept processed my maternity leave correctly, but my health insurance was a mess. I had to submit the paperwork THREE times and DD STILL wasn't added until she was 6 months old! I have to call my ped before I get thrown in Debtor's Prison for not paying my bills...

I went to that workshop too. She said to fill out the FMLA form during the 6 weeks you are off...she said try to send it in when the baby is 3-4 weeks.

with the FMLA and the City, do they count it as retroactive? Like if you use up all your sick, alv and comp time.. and then apply for FMLA, I heard they count back 12 weeks and not forward unless you come in for a day or so, and then go out.. this has me

Yes, the 12 weeks is NOT in addition to your 6 weeks paid off.
Basically, this is what happens:
You get paid until your baby is 6 weeks only! (8 for c-section). You can use your days, borrow days, and if you need a 30 day grace (partial pay-weekends/holidays). Once your baby is 6 weeks, you will not be paid anymore (unless you go back to work).
The FMLA is more about insurance. This starts from the day you take off. It includes the 6 weeks paid...and will give you an additional 6 weeks of INSURANCE ONLY.

i'm being dumb.. sorry.. but is the 6 weeks MY time.. i.e. the time that i accured? or will the city allow me 6 weeks for a vaginal birth?

not dumb. it's confusing. I suggest going to the UFT workshop. I have to look for the email or you can call the UFT (go to the one in Queens- Rego Park on QB). It was SOOOO informative and helpful.
It's your time! SO if you have 30 days saved, you will use all your days. If you have 60 days, you cant use more than the 6 weeks. SUckss right?

You only get paid until your baby is 6 weeks old. That's it.
You get a total of 12 weeks insurance (FMLA). This starts the day you take off.
So for example, I am planning on going back the first week. So let's say my leave starts Sept 12 (Im just making up a date- not in front of a calendar), I will get paid 6 weeks by using my CAR days. If I dont have enough (which I dont), I will borrow days. From Sept 12, I will have 12 weeks insurance (if I do FMLA).
So you only get paid 6 weeks no matter what...or 8 for a c-section.
You dont lose days from your bank after your 6 weeks because YOU'RE NOT GETTING PAID. You just are covered by insurance.
Am I making sense?

I have another question...I have 23 days in my bank, I was going to borrow some days (not all 20) and then take the grace period. Do I have to borrow all 20 days before I take the grace period? I forgot to ask this at the meeting that I went to.

Nope. There are no paid paternity leaves in NYC. He can take personal days to stay home with you, or he can take an unpaid, uninsured childcare leave.

They won't let you do that. You can take your 23 days, then borrow 7. Then you're done. There's no "grace" on top of that. You can only get paid for 6 weeks.
eta: Not sure when you're due, but if a school vacation falls in the middle of your six weeks, you still get paid but not docked sick days.
