omg-we bought a new car tonight
and totally got screwed...
To make a real long story short- DH lease is up- so we went to get into a new lease...
Discuss'd payments signed some paperwork and left 1k down.
We went home got the car we were trading in- and I went back to pick it up (DH had a train to catch and I was told there wasnt much more paperwork to be done)
PS- I was there 3 hrs... there was miscommunication with our down payment and paying tax title, blah blah(we were putting down 2500- they thought it was on top of taxs- we meant total)... but at that point I was told since my original car had been "grounded" it was illegal to take it home..
I then decide to roll the payments in and agree to pay the 2500 down plus first pymnt and reg fees etc.. SOMEHOW that all came to 4712.00 (Dosent make any sense to me since my monthly payments are 300/month)
I felt so preassured I ended up leaving with the car and the loss of the money. DH is going back tomorrow- PLEASE tell me he can undo this

Re: omg-we bought a new car tonight
something isn't right with those numbers- check the contact for a clause to get out of it in 3 days- it might be in there
it seems like you paid the taxes plus $2500 and the fees
I hope you are able to fix this-

Re: omg-we bought a new car tonight
Did you tell them $2500 out of pocket?? Sounds like they added taxes and 1st months payments, DMV fees, maybe a possible turn in fee too. Which would put you around $4712 mark. Sounds just about right to me. If you took the car home and signed the papers I would think it's non negotiable.

Re: omg-we bought a new car tonight
It definately sounds as though u it was 2500 as down payment plus tax and tags. What dealership did you go to? You payment should not be that high with that much down. We have a pathfinder, out of pocket was like half of that.

I think legally you have 72 hours to get out of it. Act fast and good luck!

I think legally you have 72 hours to get out of it. Act fast and good luck! Yep. Any NYS contract is subject to this as far as I have been told. Definitely fight it.

Auto leases / purchases aside... It is absolutely not true that NYS has a general cooling off period for all contracts. You do NOT have 3 days to get out of any contract you sign in NYS! While some contracts are subject to this 72-hour rule, MOST are not.
PLEASE Keep in mind that 99% of the time, when you sign a contract, you are bound to what you signed. Too many people sign things first and then really think about them later.
Helpful Link
To the OP -- it doesn't hurt to ask the dealership, as it's entirely possible that autos are subject to this 72-hour period. Good luck. I'm sorry you're dealing with this. I HATE buying cars... I've had so many problems with high-pressure tactics, etc. like this. I really hope you're able to work this out.
Good luck

There laws that allow consumers to cancel certain written contracts (door-to-door solicitations, dating services, health club contracts, and a few others), but NOT all -- heck, not even most. Also, the Truth in Lending Act (federal law, not state) lets consumers cancel home improvement loans, second mortgages, and other loans where consumers pledge their home as collateral.
I'm honestly not sure about auto purchases / lease agreements... but it is definitely not true that you can cancel any contract in NYS within 3 days. Keep in mind that 99% of the time, when you sign a contract, you are bound to what you signed.

Good luck This is good info. I am trying to remember how I found out about the 72 hour thing....I want to say it was when I was planning our wedding....

Some consumer contracts are subject to this rule, so it's possible (though I honestly do not know off the top of my head) that some of your wedding contracts were subject to a cooling off period. However, the vast majority of contracts are not. It's really important to be 100% certain before signing something -- b/c you never know!

Oh I definitely agree that you should be 100% before signing anything. I am wondering how a miscommunication could have reared its head after a contract was signed? I would wager it was not listed somewhere on the contract if the OP was misled. DH works at a dealership, and they itemize everything before the contracts are signed, including tax, title, destination and DMV fees. I would think that all dealerships would have to follow this, no?

Oh boy..Marissa, I would have gone with you!!!
So sorry about this. I don't really know what can be done, but you need to both go down and talk to the General manager and the finance manager.
It sounds like they turned you around a bit.

Did you finance for 5 years or is this some sort of a lease or balloon smart-buy? If it's a full 5 year finance I wouldn't worry too much about it.
As long as you got a good price on the car you should be OK. While they screwed up the down payment, if they did the numbers right it shouldn't really affect the deal too much financially.
Look at it this way, if you put more down on a finance you save more money on the interest for the life of the loan. If you leased it, well that's an entirely different animal.

Yes you can definietly undo it. Have someone go down there with you and return the car. They will try and pressure you but you have the right to return it! The same thing happened to my father.

Just wanted to add.... and my DH talked to the OP.. once you sign an auto contract in NY, there is no backing out. DH said only CA has a 72-hour period on auto loans. DH is a dealer and had been doing this type of stuff for nearly 18 years now.
Marissa, let me know how you make out!
1st of all your DH is soooo nice- I can thank you and him enough for taking the time to talk to me (poor man- I was a mad woman last night)
Anyways- everything that he told me was 100% correct.
We went down first thing this morning; we spoke with a manager and he agreed that the fact his staff omitted important facts for 5.5hrs- and then basically "backed me in a corner" by grounding my original car was wrong- there was nothing further they could do with the #'s- they said there was no possible way to alter the contract
They threw in free service for the 3 yr lease- but regardless- they have lost me as a customer

Re: omg-we bought a new car tonight
write a letter. Document everything. Report it to BBB.
make sure someone else knows of their shady practices.
How dare they?!
I'm so annoyed for you. I want to go kick them in the shins.

Ya know its not about the money- because after talking to Trish's DH- he basically said- I didnt totally get screwed....
I more po'd about the fact I sat there for 5.5hrs under the impression we would be paying/putting down one amount and then in the 6th hour- when I was all alone, everything changed...
ETA- they shouldve never "grounded" the car until after I signed the contract- instead they stripped my car and then when the contract was "right" they said too bad...
