Ordering from a Chapter 11 furniture store...help me out here!

I placed an order with a furniture store without knowing they were already in Chapter 11.

I only discovered it now because I went on google to find their phone number so I could call and get an estimated delivery date...

Long story short, they confirmed they are in Chapter 11, stated that their account is still active (although with a reduced credit line) with the manufacturer and they expect to have 6 out of my 7 pieces within the next 8-9 weeks. I'm not even worried about the 7th piece.

I called the manufacturer and they confirmed that the store still has an active account and they're supplying to them through bankruptcy.

I'm looking for opinions on whether or not I should reject the deposit on my credit card and move on. The benefits of this store are that their price was less, by thousands, than all of the other qoutes I received. And, the salesgirl has been phenomenol and even helped me get free repairs on my 10 year old living room furniture that was purchased elsewhere.

Of course, the negative is that they may close and I'll lose my hefty deposit...

I *think* you can reclaim that deposit from your credit card company. I would call them directly to double check.

If a company takes your money for a good or service and does not provide that good or service but charges your credit card, this constitutes credit card fraud. You should not be liable for this and the credit card company should refund you.

It is much harder to get it back from a debit type card (i.e. a debit mastercard) than from a traditional credit card.

I went through this years ago with airline tickets which were prepaid and nonrefundable and the airline went bankrupt a week before the trip and didn't service any of the flights. I was actually on a study abroad and I was able to recoup all of the money.

I would call them and ask, it can't hurt! Some cards are better than others, if you have more than one card, call both and see what kind of customer service you get.

A credit card company doesn't want to loose a good customer over a "small" charge. Small to them I mean, not small to you. A few thousand bucks is nothing to them if they have a longterm customer.

I would keep the order with them, saving you thousands of dollars as you said.

The pp was right, you should be able to get your $ back through your cc company, should the furniture store go out of business and cancel your order.
