Our interst rate expires on the 30th what are the chances...

of us getting a closiing date by then?

I am so annoyed. I called the bank and the only thing they are waiting on is the title which my lawyer has and was supposed to fax to them yesterday. I have been trying to call our lawyer all day and I keep getting the machine. Chat Icon

What is your on or about date? We got our closing date less than a week before the closing

The contract says on or about the 28th.

I would be upset as well. But, you can make this happen tomorrow without your atty being involved.
The title company can email it right to your bank first thing tomorrow. Do you know who the atty chose for you to do title? Call the title company and tell them that since the atty is not returning your calls, you decided to call yourself and get them the bank info (name, email, who is your contact at the bank, etc.) so they can email title to the bank ASAP. Explain to them that you NEED a closing date by noon tomorrow. Ask the title company if all municipals are in and be sure that there are NO clearance issues with the title company. Your lawyer SHOULD be doing this for you, but if you need to close ASAP you should take the reigns on this. Besides, your lawyer will find out that you called the title comany and it will light a fire under his butt to return your calls.

I understand being busy, but not returning a phone call? Unless he is in the hospital or someone died there is no excuse for that IMHO. Besides, it is not crazy busy work wise like it was say four years ago. I am sure he is not closing five deals a day now.
I work with RE attys ALL the time (I am a title closer and broker) sometimes this happens and it is unfortunate.

I would give the atty the benefit of the doubt (i.e.: seeing if he/she is OK, if there was a family emergency, a death in the family, etc.) BUT I would also call the title company and get things moving. KWIM?
The title company can be your ally in this and get you your date tomorrow. HTH and Good Luck! Chat Icon

I would call there first thing tomorrow and if you get a person on the phone (secretary or paralegal) ask if they can look in your file and tell you where the atty ordered title from.

I hope this works out for you.

You can also call the mortgage company / bank to get your lock extended. Hey, maybe they would know the name and phone number of the title company? A long shot, but worth a try. Chat Icon
