I doubt it can be any form of arson, but Im not Fire person IDK. I would ask him nicely not to do it. I know he may be a nut but it wouldn't hurt to ask. If not, I (me, but I can be spiteful too) I would collect them all and leave them on his stoop. Chat Icon

what do you mean by "curb" grass? is there a cement sidewalk separating your lawn from the grassy area that is against the curb? if so, i wouldn't do anything until and unless he throws one of the butts onto your actual lawn.

that said, could you prove that they are his? sounds like he would be the type to claim that they aren't his if he was confronted.

If there's one thing I've learned in life - it's don't mess with crazy people. Honestly - I would just keep cleaning them up. If he sees it's not getting a rise out of you - he may stop. He may not, but I wouldn't want to start a fight with a crazy person.

It sounds like he is being spiteful, but I hardly think this is something that would be considered "attempted arson."

I tend to think you are overreacting because you know he is being spiteful. Ashes go out. Even if you drop a cigarette in a pile of dry leaves it won't catch fire. He is not placing them directly on your property, or near your home.

I'd pick them up and put them on his front step Chat Icon

People are $hitty but I don't think there's anything criminal going on.

I would think you could get him for littering...technically it's garbage that he is throwing on your property.

I would just keep kicking them back towards his grass. Once he realizes that it's not getting the reaction he wants, he should stop.

At least I hope he does. That's annoying.

I really don't think there is anything you can do at this point. if you picked them up and piled them on his stoop, he may be just nuts enough to accuse you of trespassing. If it were me, I would clean them up without a word, and only if he escalated it would I consider a next step. They aren't near your house or even on your front lawn at this point. I don't think there is anything you can do legally.

i totally agree. i would not mess with a person who you have said is nuts. Not worth it even if you have a right to be annoyed (which you do) abotu him throwing the cigars.

i would dispose of them yourself and hope as a pp said -- that he will stop bc he isn't getting a reaction from you.

See, I would still worry about a fire starting. How many times have we heard stories of people falling asleep with a lit cigarette and the house ends up in flames?

I would just make sure to start documenting everything. Maybe not do anything about it just yet, clean up the cigar butts, and notate everything. If it ever escalates into something more, you will have everything you need to go to the police.

i wouldnt be THAT concerned with starting a fire....maybe he flicks them and they just dont reach the street and he is too lazy to throw it in the street - when i smoked i used to do that when i smoked outside my front door Chat Icon not that the street is the right place for cigarettes butts - im just being honest....i know lots of people who just flick them when they are done smoking....

Actually, it's a very real possibility. My neighbor's kids set my lawn on fire this way, with a lit cigarette. When I was a kid, my brother also set our house on fire in a similar fashion, it smoldered for hours before the vinyl siding melted and then caught fire.

However, both happened in the winter, when air and vegetation was dry, ripe fire conditions.

Since you've been pretty clear that he's a NUT Chat Icon I think you should keep your park property (that strip of grass) clear of anything flammable but otherwise ignore the cigars there for a while. I know it looks gross but if this guy knows he's getting to you, it will provoke him to continue. Document whatever you want but the police isn't going to do saliva tests on his cigars so the video might be good to keep tucked away in case it escalates.

I would leave this nutcase be for now, because what he's doing doesn't seem that bad to me. But be prepared for future issues.

Actually that's how a lot of fires are started in forests. From fire pits and smokers while camping.
