Please Help.Public Assistance, Disability etc..Does anyone know???
My neighbor just got into a very bad motorcycle accident this past Thursday. He will be OK eventually but he's going to be out of commission for quite some time....aside from other injuries he fractured some vertebrea in his back, broke his hip, and broke his pelvis. Doctors have not given any indication of how long he will be staying in the hospital. The only concrete information regarding his condition is that he will be in a wheel chair for several months.
Background Info: He lives with his girlfriend and her son. The girlfriend works FT but she doesnt make a ton of money. She cleans houses and although she is very good at her job she hasnt seen many new clients. Due to the failing economy house cleaning appears to be something that people are choosing to cut back on...She does not receive Child Support for her son. He was the primary bread winner. He had left his place of employment several weeks ago when the job he was on phased out. He was due to start a new job next week. So basically he was unemployed.Additionally works in the construction field so he is going to have to be back to almost 100% before he can resume working...He has no health insurance of any kind.
He is out of it due to medication complications that are being addressed and his girlfriend is trying to get her ducks in a row. She has filled out the applications for medicaid and has spoken to the Social Worker at the hospital...
She has asked me to find out what other services he qualifies for...Does he qualify for Public Assistance, HEAP, Social Security benefits, Ny State Disability??? What do you qualify for the short term??? Im going to search the internet and make some phone calls but I wanted to start with LIF.
These are the nicest people. The salt of the earth. They would do anything for me or my family. The types that always come to others in need. It is now them that need the help.
Any tidbit of information would be quite helpful...please feel free to FM me privately.

I'm sorry to hear this. he should apply for social security disability and ssi. she can make an appt and go down to the office and fill out the application with an agent. There is a 6 month wait though..even after you're approved. But get the app going. They will need doctors letters and they will go out for the records.

I'm not sure who qualifies for public assistance. But I agree with Blu-ize, they should start the SSI application ASAP. here is the website The social worker should be have all the information the girl friend needs. Hopefully they are helpful to her. Many to you for helping them out.

It's very likely that he would be eligible for NYS STD because of his previous employment. Someone should contact them. Unfortunately they only pay $34/day.

Just an FYI The GF would have to go after the BIO dad for child support if she was to apply for assistance. I know someone going through this and can't get any help because she won't pursue child support. I know you didn't ask about her though, but they may take her income into consideration since she lives in the household.
Was the accident his fault? He could always try to get the insurance company to pay for lost wages.

This is a brand new NYS Medicaid waiver coming out. I don't know the specific criteria to be eligible (I am actually going to a meeting on this next week), but it may be worth looking into.
I also encourage them to continue to hound the hospital social worker/discharge planners for referral sources.

Under those limited facts . . . he qualifies for NYS Short Term Disability. $170 per week. IF he applies and starts receiving it he will be ineligible for public assistance b/c the income limit for 1 person is $617 and the disability would total $680. However, he might qualify for food stamps, and he should qualify for Medicaid. The hospital social worker should be putting in an application for Medicaid for him.
As for SSI or SSD . . . the doctors must project his disability to last at least one full year in order to qualify. There are a host of other criteria, but at a minimum I thought I'd mention that.
As for her, she needs to get down to family court ASAP and file a petition for child support. The probation/intake department will complete all the paperwork for her.

After speaking to the girlfriend we discovered that he may qualify for unemployment benefits. He was technically fired from his last place of employment...he just never filed b/c he had another job coming...should he file for unemployment????

We just had this happen to someone in our family. He was about to start a job the week later and ended up in the hospital. I have to be honest, the social workers at the hospital were beyond useless. We had to do everything ourselves. We finally put all the paperwork through and was rejected. He has absolutely no assets, absolutely could not work. It wasn't until he got someone who worked in the field that help people in this situation that he got approved. Good luck!

He should have filed for unemployement beneifts before. Now he doesn't qualify b/c you have to be "ready, willing and able" to work, and he isn't. He might be able to get them for the time between the end of the job and the accident.
As for child support . . . unless the divorce agreement specifically says she is not now OR ever entitled to child support she should get down to family court and apply.
