Question about leaving company and vacation time
Just curious....my DH is giving his 2 week notice today and will be starting a new job next month. He has 1 week of vacation time accrued at his current company. Does the company have to pay him for that time when he leaves, or not?

It's really up to the company's policy. At my job now, if you leave, they will not pay you for any personal or sick time not taken, just whatever vacation you had accrued up to that point. My job before this, I left before 1 year and they told me because of that, that I wasn't eligible for my vacation to be paid out.

Legally no. Depends on the company policy. I have left jobs and been paid out for unused vacation days and I've left company's and just lost them.

Exactly. It should be spelled out in the employee handbook and agreed on when you start the job.

I'm no attorney but I think in NY if there is no written policy on forfeiting the benefit that your DH is entitled to be payed for that time. My understanding is that sick time and personal time is totally different than vacation. GL!!

where I work you have to give 4 weeks notice in order to get vacation time paid out when you leave and it cant be over a certain number of days

Depends on the company. Where I am you do get paid for it, however you need to give notice equal to the amount of vacation time you have available (we accrue time).

Thank you! It's a great career move for him and we're very excited
He found out last night that he does get paid for his vacation time as long as he gives 2 weeks notice, which he did.

sometimes they will only if you give MORE notice than the typical 2 weeks.
