Question for moms with nannys/in-home child care- or anyone else that can give me an opinion... HELP
BAckground: My landlady watches DD 3 days a week and we pay her $9 a hour which is effectively $100 a day- basically we pay $300 a week for part time day care which I know is a lot of money- but for the quality of care we get, and the convenience (we just bring DD downstairs) it's worth it.
Question: do you pay your care giver on days she doesn't work if it is a holiday- i ask b/c this past Memorial Day- which is one of her "days" we were home, we asked her if she could switch her schedule and take one of her "off" days to make up the 3rd day, and she said she could not (on the other 2 days a week she cleans homes and she couldn't rearrange her schedule)- so we only paid her for 2 days... so tonight she basically told DH that she had expected to be paid for the day she didn't work as that is what her housekeeper clients do...
So, what should I do- do I pay her the $100 for last monday? What about future holidays and the 1 week vacation we take at the end of July- do I have to pay her for that? Or if we give her a list now through the end of the year, is that reasonable notice to not pay for those days?
What about tax deduction? My accountant said if she doesn't claim this as income (we pay in cash) that we cannot write this off- what are you ladies doing? Is it reasonable to say we will pay you for days not worked if we can write off 1/2 of what we pay you as a tax deduction (so, instead of writing off $14,400 we'd write off $7200)?
Please anyone throw out some suggestions!

I had it all worked out prior to her starting and put it in writing so there is no confusion.
Yes, I pay her for any stock market holidays that fall on her regular work days. Her schedule is Mon, Tues, and Wed so she was paid for Memorial Day. She also gets sick and vacationd days and is paid if we tell her not to come because I'm taking a personal day.
No, you can't use this as "child care" unless she is licensed. If you claim her pay as you paying a "salary" of sorts, you would have to provide her with a 1099 and she would have to claim the income.

Hey Dina, 2 of my coworkers have nannies that live with them during the week and weekends they are off, they pay them for holidays and vacation.When they go away they also pay for their way including their regular pay too. I will ask them about the tax write off question.
1 of my other coworkers was going to get a sitter but she wanted to be paid for holidays, vacations and days she wasnt needed but are her regular days to work- example my gf calls in sick to work she is home with the baby but the sitter still wants to be paid b/c she depends on certain income. So after discussing all of that in the beginning my coworker decided not to use her and have family watch her. she still pays her MIL and SIL too but just for days they actually watch him.

OK, this is my opinion. Since she is not licensed or claiming this as income, then NO, you should not pay her when she does not work. You dont work, you don't get paid. That's how it should be.
You said that you pay her $9 per hour, then it's just that...by the hour. If you were to need her more hours on one day, would she not charge you?
If it was a more formal arrangement, like if she had a license or if you paid her a salary and she claimed on her taxes, then yes, I would say to pay her for the days you have off because it's not as if she asked for the days off.

I have a live-in and we pay for her holidays - and when we go away, she gets those days off with full pay. However, it was worked out before she started so I think going forward you should work out the rest of the year because what about July 4th?
But then again since you are paying per hour, I'm not sure I would give her paid holidays - we just do a straight salary for the week - it's not broken down.

I was a nanny...I got paid for Holidays that the parents did not work regardless if they asked me to come to the house and help out of not and I got paid two week vacation...one week that they would choose (for their own vacation) and one week for myself.

My sister used to have my niece in full time day care at a woman's house. She didn't claim the money, so my sister wasn't able to write it off. She also had to pay her for holidays and even vacation time. I would sit down with this woman and tell her that you hadn't thought about any of this beforehand, so let's discuss it now. Talk to your DH and see how you want to handle it. You may decide that it's fair to pay her for holidays, but not for vacation time.

I think you need to discuss this with her but since she is hourly and not licensed, I would think she should not get a paid vacation. We have to pay our in home day care lady the three weeks I am off during the school year but we agreed only to have her come one day a week in the summer instead of me paying for the whole summer. But we agreed on this before she starts in August.

That is what I am on the fence about- I was thinking of maybe meeting her halfway- paying her for her days for our vacation and for christmas week and having her deal w/ Labor Day and the day after Thanksgiving?

This is kind of sticky situation b/c you didnt handle all of this ahead of time but IMO if she is scheduled to work Monday, Wednesday, Friday or whatever days, she should get paid for those days even if you and DH have off from work and are not using her or if you go away on vacation. Whether it is on the books or not, it is a job to her and she is more than likely depending on that money to pay her bills, etc.
I would definetely speak to her and try to work something out.

I also agree with this- I just sort of assumed since when we were negotiating rates, she had said that she needed at least $9 an hour b/c when we were away she wouldn't work, etc., and needed to make a certain amount- so I assumed that days that were holidays, we wouldn't pay her...
so much to figure off- and of course, she watches my child so I don't want to offend her or make her resentful.

Maybe I'm cheap, but that still seems like quite a bit to me. But, like you said, you want to be fair so you should do what's you think SHE would be happy with. Can you do like a negotiation type of thing? Like pay for either labor day or day afer thanksgiving, let her choose, and one week vacation, again she can choose Christmas week or your vacation.

I have to say that I don't think this is correct. As long as you pay employee tax and provide her with the 1099, then it's not your problem if she doesn't claim the income. You can claim this as a salary you pay, but she will have a problem with the IRS if she doesn't claim the income.
