Questions about Leaving Jobs/Starting new ones...
if you leave a job-but u have acquired all ur vacation days-but resigned, have u gotten a check for them?
my old company is goin to give me a hard time, i know it-but they started a new policy last year that if you dont use ur sick time, it gets rolled over to next year OR u can get a check for it-so i left 2 weeks ago-and Aug 1st starts a new year for us (i know..wayyy dumb)
my new job-when i interviewed, they told me that i would get 2 weeks vacation time-but today when i spoke w/the payroll lady-she said everyone only gets 1 week
i dunno what to do

I would think if it says in your employee handbook that you get a check for any paid sick/personal or vaction time, then they would have to or you would have every right to fight them on it.
As for the new job...Unless you got them to put it in writing that you start with 2 weeks vacation, I'm not sure there is much you can do about it.

Not here. Any unused personal/vacation time is lost. If we ask they'll roll it over to the next year or pay half. But if we quit or are fired, we don't get a check for the unused time. If we did that would be SWEET!!!!!

Quote from the NY Dept of Labor
Q: Must an employer pay employees for holidays, sick time and/or vacations?
A: Under the New York State Labor Law, payment for holidays, sick time or vacation -- i.e. payment for time not actually worked - is not required unless the employer has established a policy to grant such pay. When an employer does decide to create a benefit policy, that employer is free to impose any conditions they choose. Fringe benefits may include reimbursement of expenses or tuition, health coverage, and payment for sick time, vacation, personal leave, and holidays.

First of all, you should be intitled to whatever you get as stated on your offer letter. 2nd... you should receive a check for unused vacation time. Im not sure if your last company goes by a pro rated system.
I would get on top of them & sort this out. Good luck.
