Real Estate Agent Question - Exclusive Agreeement

There was a post last week about signing an agreement to be exclusive with a buyers agent....

My husband and I signed one - we can't remember exactly when and we can't find it - but I believe we signed it in June 2008 (yes a year ago! Chat Icon)

My question is do they expire?

Something may have come up with the original house we were trying to get and we would be going ahead with it on our own and wouldn't want to involve our REA....can we tell our agent we are going to take a break from looking? Or do we have to fire her? Are we allowed to use another agent without getting into trouble? The thing is I can't find the agreement that we signed so I don't know what the terms were....

I feel horrible, this girl has been helping us for a year now Chat Icon but at the same time I want to do what is good for us and if the only way to get the house is on our own than that is what I would do.....

I used to work in a RE office. Our exclusive agreements were always for a short time (a few months) to see if we could get a jump and sell before opening up to other agencies. Talk to your RE agent and request that your house is no longer an "exclusive". Explain that you need to sell and it's been a year and your RE has not had any luck with their own leads.

she is buying- not selling

I would think the buyers agreement would have a time frame

why would you not want her help on this one?

yes - you're right, we are the buyers not the sellers....

we previously had an offer on this house - it was a short sale and it was craziness with the banks - it took 4 months to get an answer - at that point our REA kept finding reasons that we shouldn't go through with the deal....at one point everyone got fed up with her (us, sellers agent, title agent and mortgage broker) - she kept confusing things and making mounds out of mole hills and by the end it was like nobody wanted to deal with us anymore because of her - basically she is a new agent and very by the book and very nervous about handling a short sale - out of everyone involved she has the least experience so she was questioning everything (which is a good thing) but she was also confusing everyone and she herself was even getting confused - at this point i think i know more about short sales than her but that is another issue....

so anyway - we visit FL during all of this and she takes us to see this amazing house that is listed really high - but she tells us dont worry about the list price b/c the sellers agent told her they would be reasonable....so of course we fall in love with this other place - so she says we can make an offer but we have to walk away from the short sale in order to do so.....we were so fed up and this other house had a pool and yard that we loved so we walked away from the short sale thinking we're going to get this other house - and guess what - the other sellers were in no way reasonable at all - not even realistic with their price!!

so on the sly i contacted the sellers agent for the short sale - i thought i would get ignored b/c of all the drama we had but instead i got an email saying to contact him....so my husband is waiting for the call back.....

in the event the place is still available and there is a way to get it i don't want our realtor involved - she made so many issues and so many headaches and i know that the seller, sellers agent and title agent don't want her involved either Chat Icon

but part of me feels terrible....

but this is all hypothetical - the guy hasn't called my DH back yet - just thinking ahead

yikes

I could see why you would not want her invloved on this one!

but - I am just thinking that since she was involved in the begining on this house- she is entitled to the comission

with out being a lawyer and knowing what your contract states- I wouldn't be able to say if she is or isn't entitled

do you have a FL attorney yet that you could ask?

a real estate agent in FL new or not should be knowledgable about short sales these days...

ugh, for the life of me i cannot remember if we signed this agreement thing with her - at first i swore we did but i could be wrong - and now i am second guessing myself.....it's just strange that i cant find it b/c i save EVERYTHING Chat Icon

i guess we'll just wait to see what this guy has to say first......i'm not going to get myself all frazzled over nothing....

i just hope we didn't sign anything now Chat Icon

but the fact she was involved the first time around does make me a little nervous now
