If he isn't willing to go to a doctor and get a medical excuse of his sleeping, then you have to write him up. He isn't giving you an explanation. And it isn't your job to medically diaganose him.
I know two people with this disorder and there are definitely types of variations. One can drive, but not at night and the other doesn't choose to drive.

this is an HR issue and I would discuss this with them before proceeding. JMO
eta: any performance related problem needs to involve HR. this IMO falls into that category.

We did ask hr and they said it is up to us. Since his work is getting done, there is not much we can do.
we have even offered him another office to go for 20 mins a day and take a nap, which he hasnt done!
So then they would be okay with all your employees taking naps as long as the work is getting done?
I agree. your HR person sounds really lazy IMO.
this is 100% an HR issue! and of there is no policy against it, I suggest they implement one.

Opps just read the HR response! First things first you need a new HR person! Sleeping on the job is not ok whether or not they "get their work done", I suggest you speak to your boss or someone else in a higher position. They need to educate the HR Person.

he may have sleep apnea so he's tired during the day because he's not getting sleep at night.
Either way, be straight forward and direct. Ask him to put himself in your shoes. How is it acceptable to allow an employee to sleep on company time? Also, let him know that your conversation will be kept confidential. If you open the door, he may be open to discussing it with you further. He may have a problem and is embarassed by it. He may also not give a crap about it since it's been tolerated for so ling. Let him know that it's not fair to other employees. No place of employment would allow an employee to sleep on company time. If he cannot stay awake for the work day, then he needs to address why.
I also agree that if he is able to get his work done and take snoozes a few times a day, he is not busy enough.
I was thinking the same thing with the sleep apnea. It's a serious disease, you basically stop breathing for a couple seconds at a time during the night and your body never goes into a REM sleep, which is what you need to recharge.
Snoring is a big indicator of that also falling asleep during the day as well. People who have sleep apnea don't know they have a problem until someone points it out to them that they fell asleep during the day. He's needs to go to the dr and do a sleep test.
