Spinoff to "Fence with Neighbors"
It's great if your neighbors are willing to go in half on the fences on each side, but what if someone sells their house and the new owners don't want the fence/don't like it and they want to take it down. If it's right on the property line or in one property more then the other, what would happen? Would the fence have to come down and be put back up? These are the things I'm worried about if we ask our neighbors to split the fence cost. If the fence is on our property line all the way around, then I wouldn't care because if the neighbors sell then a new homeowner could just put up their own fence on their property line. I hope that made sense. I just wouldn't want there to be problems in the future if you put it in the middle of the property lines. What are your thoughts? Does the town have rules on something like this? TIA!

Jen, why dont you just put it on your property line then. Your not talking feet , its give or take a few inces. We did that & the neighbors went half with us

That's a great Q, I'd love to know the answer too. We didn't ask our neighbors to kick in for our fence so it's all ours and on our property but I am curious what the law would be concerning that.

Yeah you are right. Well as long as the neighbors are game then and want to pay half and are ok with it on our property then that is good for us. We will just have to get a survey done so we know where our property line is for sure.

When you purchased the house , did they do that ? I know with mine, our property line actually was on the back neighbors property & we had to state if we wanted to claim it back or not. You should have the survey allready.
In any event , weather they go half or not, its a great investment for curb appeal ,,

It's great curb appeal no matter what! I need some more curb appeal.

The neighbors right behind us technically had their fence on our property which we discovered through the title search. It just barely hit our property though, so we were okay with letting them keep it where it is. However, we could have asked them to take it down. We did get them to sign a document that indicated they did not claim the property, and they acknowledged that the fence may need to come down if we ever wanted that property.
Hard to say if it is running right on the property line, but it's so tricky to get that exactly right. I'm thinking if the fence is at all on another property and one person sold, the new owners could remove it if they wished.

Yes, be careful with that. That's your agreement with those neighbors. If they were to sell their house in a few years, the new owners may not agree at all with this agreement. They could ask you to remove your fence if it's in their property.
We put ours just in front of the old one. Just by a few inches in case the old fence was "slightly" over the neighbors' property.
