Tax return question - regarding debt..

Sorry for the situation-questions. I feel like I get so many great answers from here that when I don't have an answer for someone, I usually say "I'll ask the LIF ladies and get back to you".

Anways, my girlfriend is REALLY defaulted on her student loans. Like, they're gonna start taking $$ out of her paycheck defaulted. ( don't know how it got that bad but whatever - not my business)

She got married 2 years ago but this is the first year they are filing jointly. She is wondering if the IRS will keep their refund, even though it's HER debt and not her spouses..
Her accountant couldn't answer her. She has owed both State and Federal in the past two years so she has nothing to base it on other than she didn't get a Stimulus check this year.

Any ideas? My guess was that they'll keep both of their returns. I didn't wanna tell her that though if I didn't know for sure

I think they will keep her State, for some reason I think she will keep Federal. But I'm no expert!

She should really try to call them, usually they will really work with her

She will get both refunds unless it has gone to a judgement.
