The teacher's union would be upset if they knew. This is free labor, especially since the student teacher will not be mentored from a a master German teacher. A union, if they knew, would challenge it immediately. If the district gets away with it once, before you know it a student teacher will teach calculus while a certified English teacher is merely present to lend some odd version of legitimacy to the situation.
If this student teacher does not have certification he or she should not have been put in this situation.

I actually think the school district knew that they had a bad teacher on their hands, they were pinned down, and that this ST is probably a saving grace to them. I believe that NYS law says that an unlicensed teacher can serve as a per-diem-sub for 45 days max? As long as they're enrolled in an educational program at an accredited college or university. I am sure the school is making sure this guy is doing his job, and your child is much better off than with the other nightmare of a teacher. I am currently a public school teacher highly active in the Union. If this situation happened in our school, we'd make sure that the Spanish teacher wasn't responsible for doing any work outside of her contracted responsibilities without being compensated appropriately. I highly doubt the union would be upset about this situation if there was no one waiting in the wings for this job. German teachers are hard to come by.

Yes, I'm writing an email to the department chair basically inquiring as to what the eff is going on.
Maybe start with asking if this is temporary situation and when they expect to hire a new German teacher?
