Texas shoppers smash window to save kids in hot car

KATY, Texas -- Shoppers who thought they had no time to spare after noticing two kids in a hot jeep Monday afternoon took matters into their own hands.
The incident happened at a strip center near North Fry Road and Little York. Some of them tried to smash open the windows to try and free the small boy and girl.
“It was a crazy situation,” said Gabriel Del Valle, who used his cell phone to shoot video of the incident. Del Valle said he stepped out of his nearby shop after hearing the kids crying out in desperation.
“The kids were in there crying,” said Del Valle. “I mean you would understand. It’s real hot. Gabe said one guy used a hammer to shatter the glass. “And even then they could barely open the doors because there was a child lock on. Kids were in the crying.”
After several minutes, the kids were freed. The children’s mother apparently said she had left them there only temporarily so that she could get a haircut.
But Gabe thinks nothing justifies treating children like this.“Even a dog can die so imagine a person,” he said.
No one called the police. In fact, Gabe said the mom pleaded with everyone and said she had made a terrible mistake. Fortunately, it appears the children were unharmed.

honestly this is getting out of control, of course we all hear the stories about people who have a change in routine blah, blah, blah, but we keep hearing about while parents are shopping!! and running errands,its out of control and honestly every parent caught leaving their child in a hot car should be held responsible for stupidity, police must be called, even if they just have to pay a large fine something must be done, its out of control

OMG!! Unreal!! They need to press charges against the mother!! I flucking haircut?? Hire a babysitter!! How are these parents such idiots?? What do they think it will feel like sitting in a car in the middle of summer with rolled up windows, no a/c & all alone?? I am so angry.

My dh and I were discussing this the other day and I warned him to be prepared bc if I ever see a kid locked in a hot car I will use anything including his head to get them free

DH & I actually have one of these in both of our cars...and this was my immediate thought that we'd use this with no problems if we ever saw a child in an unattended hot car!

That mother is going to make the same "terrible mistake" again. They should have absolutely called the police. I don't care how much someone pleaded with me I could never let them walk away from that. What a POS. Over a haircut? People are disgusting.

I had that in my car for years. I'm pretty sure it got tossed when I sold my car.
This is a case where you call 911.
I'm just curious for the attorneys: What liability would someone had who broke a window on a car to save a child?
What if the child got injured in the process?
Before everyone gets up in arms, yeah - someone's dying, I'm sure I wouldn't give rat's behind about it but I was just curious.

I'm guessing, so I could obviously be wrong, but there would be legal ramifications. Damage to their car. Injury to their kid, etc. I mean, someone who breaks into your home and injures himself and legally sue (and win) in the USA

I would make every attempt to smash a window that was not near the child but I am getting in that car no way no how.
If they sue me for breaking the window, I am pretty sure that would get dismissed, and if it wasnt- how much is a side window? $200? I'd gladly pay it.

There was a law passed recently addressing this exact issue, but I don't think it was in Texas. The law sated that the passerby should call 911, look for an alternate way into the car, and then break the window in a way that wouldn't harm the child if there was no other way.
I don't know what the legal ramifications would be in states that do not have this law, but I would follow these guidelines if I was in that situation.
ETA- It was Tennessee which is where that story with the Dr. took place & most likely is what prompted the legislation.
