You will not lose your right to pump. The breastfeeding provision under the ACA provides that if there is a discrepancy between State and Federal Law, the stricter standard will apply.
NYS already has a rather strict breastfeeding at work law (in place long before the ACA).
Also the coverage under the ACA only applies to companies with 50 or more employees and only applies for one year from birth of the child. NYS laws are much stricter.
So what about people who live where there is no state protection? I don't only care about myself.
What about people that don't work for companies of 50 or more?
Like I commented yesterday - the ACA protection applies to ALL employers regardless of size of business. The only difference is that businesses with less than 50 employers can choose to APPLY for an exemption and then must prove undue hardship.
That is not exactly true. You do not apply for an exemption. If an employee complains, then the employer must show that it causes undue hardship. The exemption is considered in existence unless it is specifically not granted.
