The prosecution is killing it!!
Rep. Castro was on point. Well spoken, armed with facts. Trump's pathetic lawyers don't stand a chance. When you see everything presented in chronological order it's impossible to argue that he isn't guilty as sin.

Unfortunately, none of that matters. Not even evidence matters. I can't see enough Rep senator voting to convict. I don't even think if Pence, was in fact killed during those riots, that the Rep. Senators would convict.

Unfortunately, none of that matters. Not even evidence matters. I can't see enough Rep senator voting to convict. I don't even think if Pence, was in fact killed during those riots, that the Rep. Senators would convict.
I'm trying to stay hopeful, I don't know how anyone with a brain can clear him after the evidence presented. It's so black and white. I guess if nothing else, these Senators will have to go on record and go down in history as weak, self serving, spineless, complicit pieces of garbage.

I completely agree! He even said himself. He could shoot someone in Times Square and people would cheer. This is disgusting how justice is NOT being served.

it's disgusting because many of them would vote to convict, but they're scared to lose money and/or votes. pathetic.
makes me want to move to where they're from and vote against them.

This is a kangaroo court. Our democracy is a joke. We’d openly mock, invade, or sanction other countries for this.

I know, they are really hard to watch. I know there are many Senators who will continue to turn a blind eye and be complicit but after yesterday, it's REALLY hard to believe that they will likely acquit him.............AGAIN.

I am not a lawyer so I could be wrong, however, if Trump is found guilty then wouldn't they have to let everyone off that actually stormed the capitol since they can now use the defense that they were acting on direct orders from the president?

They still went in of their own free will. He incited them, but he didn't force them to go in, so I think it would be a difficult defense to prove.
I'm also not an attorney, so I don't know. That's just my guess.

Any lawyers want to weigh in? I am very curious. I do think it is a legitimate defense and I think they the charges will either need to be dropped or lowered. A reasonable person should expect that they can follow the direct instructions of the president without facing legal prosecution. Considering that the president can declare war, etc....
ETA: It was almost like trump declaring war against congress and declaring them the militia to carry out this war....

Even if the Senate does acquit Trump; that doesn't mean that Trump still can't be charged with Federal crimes and state crimes surrounding this. I am not an attorney or a Parliamentary expert though.

My thought is that the defense would be that he declared war. I actually came to this conclusion after listing to the lawyer who was representing the Virgin Islands that testified yesterday.

Funny I was actually going to use the mob boss example. Almost always I believe the person who paid the hit man gets more time than the actual hit man themselves. However, being a hit man is different than acting on the direct orders of the commander in chief of the US armed forces when he essentially declares war on congress. If anyone is listening right now to the trial, all any defense attorney has to do is play a video of this testimony. I think all they can be convicted of is gross stupidity and I am not sure that's a felony.

But, Trump would have to have conceded that he used his presidential powers in support of the coup of the mob/rioters/ etc. It was an attempt at a coup to keep himself in power and to usurp the peaceful transfer of power. So, for the rioters to use the defense that they were called to war, Trump would have to concede that he declared war on the US. Which would mean that he could be tried as a war criminal or a terrorist. I just don't see how it could flow logically. Even those under Hitler were not able to use this defense when tried for their crimes.

But, Trump was not calling the military to action. Trump was calling a bunch of self proclaimed Patriots to siege the Capitol. The rioters used the American flag to beat a police officer. I don't think the rioters can hide behind a call to war declaration by the US president. They attempted a coup and should be tried as domestic terrorist. imo
