Town Trees

are there fines if you take down town trees (8 feet from the street)?

Has anyone done this before?

The town owns 10 feet of the property from the curb called an easement. If the town planted the trees, they own them as well. I would call the town and tell them your situation. If the trees need to come down, they will do it. They do it in my neighborhood all the time. I've, also, seen trees taken down for no apparent reason other than the homeowner wanted them down. Better to be safe than sorry.

I live in brookhaven, and my neighbors said that there is a fine if they find out you took them down, but they said they took down town trees a few years ago and no one said anything. Unless your neighbors rat you out, how will the town know?


If you are in Brookhaven, call the Highway Department. I have a town tree I want to take down. its not dead, but its shades my entire front lawn. I want it to go!

Yes - I'm in Brookhaven - I called the Highway Department. They "said" they will come out and take a look at the trees, but they never asked us to mark them or anything. I hope they take them down - there are so many trees that our lawn won't grow... not to mention the 60 bags of leaves we clean up each fall just in the front!

I plan on getting everything documented with the town - my neighbor regularly calls the cops, 911, the highway department and the board of health. She is lonely I think - its a blessing and a curse to have a neighbor like that. Chat Icon
