Unemployment Claim Denied. Help Please, please.

Ok, here's what happened. I got laid off in Dec, with a very good severance. So, i didn't apply for unemployment until last week, a day before I was gone on vacation for a week.

I moved to NY in April, and started my job in May. Unemployment goes in quarters. My first one (Q2) was April, May, June and the second (Q3)July, Aug and Sept. Because I was laid off in Dec, the oct, nov, dec doesn't count (which won't help me anyway since I only worked 2 of tghose months).

There's some stupid rule that if your last quarter is over X amount then the previous one has to be Z amount. I'm over for the X amount, but since I only worked 2 months in Q2, I just miss the Z cutoff by $200, no lie.

You have 10 days to dispute the info, however 10 days was Monday - I didn't get home until early Sunday and didn't even open my mail then. I thought that it would just be info - that is what they were supposed ot be sending, and nowhere did it say on the web site that I could be denied, since I passed all of the other tests you go through.

So, even if I DID I have time, I can't get my paychecks because everything's electronic - I don't even know the web site thy used but I am sure I don't have access anymore. This would be a reason why i refuse to go paperless for these kinds of things.

Also, the letter iS unclear if they all have to be in NY? That whole form is confusing. If it's just in NY I am SOL, if not then I am still screwed because I don't have access to my pay stubs.

I can't reapply until after March 31... that will be fun times if I don't get a job soon. And it won't matter, but I guess I can try to write them a note or something. I don't know.

So, long story short, this system is screwed up. Is there ANYTHING I can do before March 31? And to dispute it, do all my paychecks have to be in NY or can I use them from my job in CA? I'm hoping I have my username and pw for the paycheck site written down somewhere, if I can remember the url.

I would call them. You may have to apply to CA not NY.

Also, you can get UE even though you collect severance.

you can always try a claim in CA... even though my DH is in NY he collects through NJ b/c that's where he worked for most of the year.

Maybe I will try CA? I didn't think I could but it is worth a shot. I am getting my pay stubs from there so I can at least dispute this.

I think what po'd me the most was that when I checked in the web site for my first, non payment week, it didn't say that I have been turned down. I felt totally blindsided and had no time to correct it.
