**UPDATE** MY LANDLORD HAS LOST HIS DAMN MIND!! When does the heat have to be turned on officially? ?

We live in a private house and our landlord has not turned our heat on and it was FREEZING in here last night. We had to turn the oven on. For myself and DH I don't care too much, but now that DD is here and she's only 2months.. this as a problem, especially because it's going to be pretty chilly the rest of the weekend/week.

***UPDATE***
He told DH he's not turning it on until November 15th!! This man is CRAZY if he thinks I'm going to sit here and freeze or keep the oven on all night just to get some damn heat!!

311 says heat is to go on in buildings/houses effective OCTOBER 1st!!!!

These are the regulations for NYC...


The 2007/2008 “heat season” begins today and continues through May 31, 2008. During heat season, residential owners with tenants are required by law to maintain an indoor temperature of at least 68 degrees Fahrenheit between 6:00 A.M. and 10:00 P.M. when the outdoor temperature falls below 55 degrees. Between 10:00 P.M. and 6:00 A.M., building owners must maintain an indoor temperature of 55 degrees when the outside temperature falls below 40 degrees.



I always thought those temps were on the chilly side. It was 68 degrees in here last night & I needed an extra blanket for a while.

You should give your landlord a call and tell them to turn up the heat. The temps dropped quickly this week.

i live in a coop and my place said not until novemer meanwhile my sil lives in a coop and her place has it on by 0ct 15 whicth i thought was the time it was supposed to be on.... my kids were freezing!

My lanldord told DH he's not turning it on until NOVEMBER 15th!!! I called 311 and they said it is supposed to be on October 1st!! Granted we didn't need it in the beginning of the month, but it was COLD in our apartment the other night and my DD was freezing!!! Is my landlord nuts? I told DH we are NOT paying rent if they do not turn the heat on by tomorrow!

I would buy a portable heater, but be VERY careful!!!!!!!!!!!!!!!!

in most buildings I have lived in it was the 15 of October or the 1st of Novemeber

in my current place- which is a house- we have our own heater

please don't sleep with the oven open- get safe space heater- and you should even be careful with that-

What type of dwelling are you in? I think there may be different rules for different types of buildings based on the number of rental units. I would call 311 again or the housing dept to find out what type of recourse you have and make a report.

You might also want to consider getting an indoor thermometer so you can say for certain that the temps are below the amounts required to be maintained in my post above from the housing authority.

I agree. I actually think it is suppossed to be on by oct. 15. You should do some research on this.

I would call the Department of Health and report him immediately. The heat should have been turned as soon as the temperature dropped below 55 degrees.

We live in an apartment in a private house and have control of the thermostat. However..he shut the heat off last winter and didn't tell us so we have NONE! It upsets me because when we lived upstairs last Winter it was sooooooooo cold in our apartment and we used to complain all the time. They told us they were going to wait until the Spring to have the windows checked. However, then we moved into what was there apartment where it was ALWAYS warm and figured now we have control of the heat..so it shouldn't be a problem. They came last week to tell us they are having some of the windows replaced upstairs and in this apartment - which didn't need it.

We pay $100 more than we were paying upstairs because Gas is included, We pay for our own electricity. But... you know they are RIDICULOUS if they think we are going to be w/out heat or having the other tenants come to us to complain because there is no heat.

When DH asked if he was going to turn the heat on soon..he said " YOU NEED HEAT??".

I knew it...I told DH I can see this being a HUGE problem once they turn it on because DH is home during the day and the baby will be here as well which means the heat will be ON! They used to shut it off when they weren't home during the day and he'd be FREEZING! So imagine now....it's just going to get worse, especially if the bill comes higher than it did when they were here. Well hello..you were not home ALL day, DH is because he works nights and we shouldn't have to feel bad or scared about putting the heat on. This is why I can't wait to move already! Just one problem after another!

I don't understand why they are so frigign CHEAP!! THey don't pay a mortgage on this house anymore, have 3 apartments they are receiving INCOME from and a business and have the NERVE to complain about things like Heat and their damn hall light being left on by the tenant who doesn't pay for light or gas!! I know heat is not cheap..but that's not my problem. What is my problem is not having any heat when we are paying $1600 a month and have a 2 month old baby!

Being that I just turned off my central AC yesterday I don't think I'm turning the heat on just yet.

If it's THAT cold in there then I would def. get a space heater or something - if you thinking that talking to the landlord isn't working.

Yep they know..and that was one of the concerns we brought to their attention LAST WINTER "once the baby comes ..etc etc etc" and their exact words were "don't worry". Ummm...I'm worried.

if you're paying $100 a month for gas, tell them you'll be deducting that from your rent until they turn the heat on.

He can't say he will arbitrarily turn the heat on in a month but it hasn't been cold enough to make it required by law.

I was preggo last yr and living in a different place. The landlord also told us October 20th. I was freezing multiple days and we also used the oven for heat. We left as of Nov 1st.
Maybe you should find an apt in a complex instead of someones house. Since I did that I have had NO problems whatsoever.

Please do not use the oven or a space heater when you are sleeping. That is highly dangerous. My FIL is a fire chief and can't count the number of times he's been to fires where space heaters and ovens were used.

You need to call him and tell him he has a legal obligation to turn the heat on. Say you have a 2-month old baby and if it's not on within an hour, you will be reporting him.

We are DEFENITELY doing this!! It just really sux because we want to get a house, but we have no choice, we need to move ASAP! Just need to come up with the $$. I'm going to be working a lot of OT to get us out of here FASTER! Can't take it anymore..
