Update on the Sleeper
Wanted to give you all an update:
Spoke with a different person from HR this morning (The original person was new, and didnt have much information)
She told me to bring him into my office and have a closed door meeting.
in a nice way, orally give him a warning that this is not acceptable behavior and it is a poor example to set for the new employee.
She said to be sensitive because it is quite possibly a medical issue, and she did bring up to me sleep apnea. She also suggested that i gently suggest he go to a doctor and that if the condition persists, that we require a doctors note to explain his falling asleep at certain times of the day.
I am also going to mention that I am aware that his prior boss has mentioned this to him and that it is still as unacceptable now as it was then.
I am going to give him another chance, and tell him if I catch him sleeping again, I'm going to have to write him up.
I am going to call him into my office in a bit.
i would like to thank you ladies for your advice and support, this is the first time I have received so many responses on one of my posts, I feel like I'm finally starting to fit in!!!

He had to leave early yesterday to go to the 'doctor'
and then he called in sick to day that his back was out..
We'll have to wait till Monday!

Ok since it didn't go. Can I make a suggestion?
Instead of telling him you need a doctor's note explaining why (which is a violation of his right to privacy, HIPPA), say that HR needs a doctor's note that spells out what type of accomodations are needed to make for his disability/illness & then you can check with HR to see if they can be accomodated.
We have our employees fax doctor's notes directly to HR. The manager shouldn't see them nor should they see what type of doctor it is (ob/gyn, psychiatrist, etc).
