I really hope this works out well for you! The stress is totally not needed for anyone, but especially for you being pregnant and have a young child.

Unless the contract says you can sue him for specific performance then you cant force him to close even with a lawsuit. /You would only be able to sue him for damages although some contracts say that if seller defaults you get your downpayment back and that is it. Unfortunately and I feel terrible you may want to start looking again unless your attorney can do some serious pleading on your side to get him to change his mind.

Do your buyers live in an apartment because maybe you can close on your current place and pay them rent until you find something else. I hope it doesnt get to that but options to consider. Then I would sue the seller.

If it was me, i'd sue them regardless of what the contract says and let a judge decide.

It is most likely the contract won't say anything regarding seller non-performance, so it would be up to a judge to decide if compensation should be awarded.

It doesn't hurt to try. Put the pressure on them by dropping them with a lawsuit. I find that is the best way to get people "to move" on an issue.

I hope the seller agrees to the amount you proposed! Our first home fell through for different reasons, but I can honestly say that the house we finally ended up with is even better than the first house. I hope the next home you find is even better! And I agree with other PPs, I would sue him for all the inconvenience and stress he is causing you! Chat Icon

Well that s*cks! Seriously! I'm sorry.... That really does s*ck. But try to refocus on the baby and I bet an even better house will come along. It may not seem like it now, bc you are no doubt nesting and would like to be settled for obvious reasons.
