upset about our new fence
We had our fence installed today. It's gorgeous and WAY nicer than I expected (we tried to spend as little as possible, while still getting a decent fence).
BUT, they measured wrong when they came a few weeks back, and they had to move the fence in a little bit, because they didn't order enough sections. Basically what it amounts to is that we lost some square footage from our backyard because they placed the fence a few feet IN from our property line.
We had the choice to wait a couple more weeks for them to get in the new sections, but we've already been waiting for a month and just wanted it done.
Now I regret it. No one would be able to tell and I am sure it really doesn't matter, but I'm still bummed.
I'll post pics tomorrow.

A" few FEET in" around your property is a lot of area. No way would I settle for that. They measured wrong and that should be fixed asap. I would not just suck that up at all, no way. Plus your neighbors may think that extra space is theres which could cause issues down the line if someone new moves in. I would get that fixed asap.

This would be my concern as well. I would make them fix it.
I was thinking the same thing...you might "lose" some of your property

Yes, I think there's some "law" or regulation that if a property line is "moved" and it stays that way for a certain length of time, you forfeit that property over to your neighbor(s) and they re-draw the property map, so to speak.
You must have that fixed!

No, it's not. Eminent domain is when the government/state has the right to seize a person's property without his or her consent.
Adverse possession is what the pp described, but several things must take place in order for adverse possession to apply. You won't lose part of your property by simply putting a fence around most, but not all of your land.
ETA: If the company made a mistake and you're unhappy about it, you should try to get them to fix it.

Thank you all. Honestly...the property we "lost" is on the side of the house, right alongside our neighbors driveway. Here is a picture...
You can see the 2 feet of grass through the fence...that's OURS too.
I think it's too late. We honestly though that THAT was our property line and it turned out that the actual line is right alongside their driveway.
The fence guy asked us if we wanted to wait and we said NO. So I think it's too late. It's our fault at this point.
ETA another pic...those are my black raspberry bushes that are taking over the garden...

I would still have it moved. Thats a lot of property to give up but thats just me. You have a beautiful yard by the way Fencing is crazy $$$ and I would ask to have it done.

this is correct. it's Adverse Possession, not Eminent Domain. it takes 10 years, and as the pp stated, several things must take place before the laws of adv. pos. apply. your neighbors (or future neighbors should they decide to sell), may or may not file an order to "Quiet Title", basically claiming that property as theirs. I'm with DMT on this one; I'd move the fence to my property line. beautiful fence btw!

If its any consolation, I love the fence! It won't hurt to call and see if they can fix it, since they did measure wrong to begin with!
