Maathy's right. You can kick him out, you can change locks, you can have him arrested if he tries to break in. Your mom needs to do everything she can at this point to protect herself.
I don't get how she admitting herself to a psychiatric ward is the solution - what becomes of your brother then? The house?
Well she feels since he wont leave- then she will....she feels trapped, and cant get away from him- so if she is put in the hospital... then she wont have to deal with him...
As far as throwing him out, she was told by the courts and the counselors, she could not throw him out.... since he was a minor, she had to continue to provide a home for him, unless he chose to leave....
Wouldnt CPS be up her @ss... if she threw him out???
ETA- as far as if she left what would come of everything else.... well I guess they would all become my responsibility now... huh?

I think she needs to get a straight answer - honestly I would go to a lawyer if I were her at this point. She's told he has civil rights since he is 16 and she can't commit him anywhere but he can't be thrown out. Don't know if that's 100% true. If he is a danger to her, she can kick him out. She really needs to speak to a lawyer if she is not getting the answers she needs from the courts. Has she spoken to the school's dean or AP. Usually the person in the school who deals with the discipline issues is a wealth of knowledge on these topics.

She has a lawyer, and an order of protection against my brother.... if he violates he will go to jail... but at this point its so much more than him acting violent, and being on drugs....
The school is well aware of everything.... the schools probation officer (he has a more official name but I cant think of it right now) caught my brother outside smoking pot.... He was not punished, just a call was placed in to my mom....
He gets in school suspension for cutting, but he dosent care....
He knows he can continue to cut school and detention, and NOTHING can happen to him (other than not graduating)

It is so sad the system is letting your mom down. If this was happening at my school, he would have been suspended and refered to the police for the weed incident and assigned a probation officer whether or not you mom asked them too. As his dean I would update the judge about him not attending school and he would be sent to a juvenile detention center. But this is Cali, not NY.
Have you mom look into a PINS petition- Person in Need of Supervision- I remember using this when I lived in NY for out of control kids.

I just wanted to say I am so sorry your mom (and you) are going through this. Does your dad know whats going on? I was originally going to suggest having your mom stay with you to keep her safe, but then the house would be available to your brother, and thats not a good thing either.

They did away with PINS... now they have the AFY program... which is volunteer... this juevenile drug court program he's in, is a step above that....
He is supposed to be going to school everyday, and following a curfew.... but the only thing the judge seems interested in, is him passing his urine drug tests...

I am so sorry that you and your family are going through this. I think your mom should contact CPS and let them know what is going on. She can voluntarily give up custody of him and they can place him somewhere.

You mom can't be of any help to anyone if she can't handle it, or has no real support -so maybe admitting herself is the help 'she' needs right now.
Where is your dad? Can an intervention be done for your brother?
Wow, I don't think this is your responsibility if your mom was not around, unless you want to take it on..
