When the bank says clear to close **Vent ahead**

Does this mean they are still reviewing the title? On the 19th we got the clear to close from the bank. I called our attorney today to see what was going on as far as closing, she said the bank is still reviewing the title, is this common?

I am just so defeated in this whole house buying process. I know people have it so much worse and I understand this, but I am pregnant, was supposed to be out of my apt by april 1st and now this comes up. I can't close at all next week so it looks like it's going to be two weeks from now. I am seriously crying at my desk out of frustration.

My realtor told me to suck it up, nobody closes on the on or about date. I understand this, the on or about date was also 2/15, so i am pretty sure I am not still holding on to that date. She basically said oh well this is the way things go.


ugh if you made it this far, thank you! Just another vent in the long line of house buying.

I'm sorry. That's a pretty sh*tty excuse that the realtor gave. I hope it finishes for you in 2 weeks and you guys can forget about all this and just move on to enjoying the house. Hang in there! you've made it so far, 2 weeks will go by quickly!

The clear to close, for us, meant all that was left was to set the date. There was no more reviewing after that. I don't understand what your bank is doing, and why your realtor isn't trying to light a fire under anyone. Our realtor was up everyone's butt for us if things stalled out even for a day or two. We closed in a week of our C2C - but we had the date set within two days.

Don't these people want to close and get their money???

This. Cleared to close should mean there is nothing left to do but close. And it is a common understanding that closing takes place within 30 days of the "on or about date" in the contract. Your real estate agent's response was really crappy Chat Icon

I got my clear to close an hour ago and we're set for Friday. If there's nothing left to review, it's just a matter of setting the date and time.

Can I say I hate you just a little :) is it too late to switch to the people you used?

I got my clear to close March 19th, I am furious. The realtor made it seem like this is the norm and just deal with it. I understand things happen, but my understanding was once you hear those magical words, all is good.

The sellers realtor keeps texting/calling our realtor, I know they are anxious to get this done!

It was my belief that these people were fighting for me.

Realtor just called, supposedly they're waiting for one piece of paper which should come today or tomorrow morning. So still not closing. I can't close next week at all. Which means mid- April.

I know in the grand scheme of things this is so minor, but there are so many things going on, so many things they sai were going to happen and didn't. I am not even excited anymore.

Clear to close means that the bank has cleared the file to close and the attorneys can go ahead and set a date. I have never heard of a bank clearing a file while it's still waiting on or reviewing paperwork. So that doesn't seem right to me.

I have had it happen that the lender clears the file to close, but the buyer's attorney wants to further delay because they are waiting on something, like a new survey, for example.

It sounds like you are getting all different information from different people. I would not rely on your realtor to pass on accurate information.... it sounds like you've lost faith in her and she's hasn't been on top of things. I would go directly to the source and call your bank to get clarity that they have cleared the file to close and, as far as they are concerned, a date can be set. I would also talk to your attorney directly to find out why he thinks the bank is still reviewing the title and how that can be reconciled with the fact that you supposedly have been cleared to close by the lender. Make sure that the delay is really something on the bank's end and not on your attorney's end.

And if it is on the bank's end -- have they locked your rate? When does it expire? Because if the rate lock will expire and the delays have been caused by the bank and not any feet dragging on your part, they shouldn't charge you to extend the rate.

Finally, why would it take 2 more weeks? If the title report is in, and it just needs to be reviewed, I feel like it could be reviewed tomorrow, your file could be cleared, and you could have a closing set for early next week.

So sorry you are having such a negative experience! At this point, I would cut down on the extraneous communications with your realtor and all of that, and try to go directly to the source of info you need (the bank, your attorney, etc.). And if they say to "suck it up" - - which isn't really very nice or professional! -- you need to explain: The issue isn't even so much about the delay in closing, but it's the lack of information/misinformation about the status of your file and why there is a delay. You need to know WHAT exactly is going on and when you can expect to close, and you have a RIGHT to know!

We also received our clear to close before the title search was complete...but it was up to our attorney to order the title and provide that to the bank's attorney before the bank's attorney would schedule the closing.

At this point, forget about going through your realtor. For her to say something like "suck it up" is wrong! You have every right to be upset and to want to move forward with the process. If you're asking her to make these calls for you, I wouldn't be surprised if she's brushing you off and just not doing it because she thinks this is "normal". At this point you need to take matters into your own hands and make some noise.

The attorney is who ordered our title for us. And your attorney is getting paid for his/her services so you have every right to make a stink to find out what the hold up is! Tell them you want to know what the hold up is with the title and when it's expected in. If they don't know or no one will take the call, keep calling until you get an answer! If it's already in, tell them you want to be informed when it is sent to the bank's attorney. As soon as it's been sent to the bank, call your loan officer to confirm its receipt and find out when you can expect it to be reviewed.

It's only when the bank's attorney has this info that they'll even talk about scheduling the closing. They won't do anything before.

In our situation, we were cleared to close and that day we were pushing for a date. Our attorney wouldn't return our calls and got an assistant to tell us the bank wasn't responding. So I called the loan officer to find out and she was the one that told me the bank's attorney had been leaving messages for our attorney inquiring on the title because he hadn't yet sent it! After hearing that, I wouldn't hang up the phone until I spoke with someone at our attorney's office. I literally demanded to be connected with someone. Two days later, the title was in the bank's attorney's hands.

You are your best advocate. Please don't rely on this realtor to look out for your best interests. It sounds as if she doesn't want to do the work of calling. Get on the phone and start making those calls. Believe me, the process IS stressful - and the most stress came after we got our clear to close! But I promise you're almost there and in the end it will be worth it!!

The whole thing is a mess. The worst part is if we don't close this week, I can't close next week, if that's the case I am going to look into letting my mother or even the lawyer be the POA so that my husband can go and close since I can't next week, which is devastating when buying a new house. I want to sit there for hours and get hand cramps, but at this point, I need to be in the house more.

Yea my realtor sucks, I've already unrecommended her and the mortgage broker to a few friends who I first recommended them to. I finally spoke to the broker who told me, we are clear to close as far as the loan, apparently the closer wants a little more explanation on something that came up on the title. It's an estate sale and the son who inherited hasn't made a payment since September, so it's on the verge of a short sale/foreclosure. My broker said to me " I haven't called you because although you got the clear to close, you really weren't" my response, you knew that I thought that, so why wouldn't you call and let me know. I also spoke to my attorney last thursday and he said that we would close this week, so this missing paperwork is something that he didn't even know about. He's on vacation until tomorrow and then I am calling him. It's just so frustrating!! I know an extra week isn't a huge deal, but at this moment, it is, lol. If she would've called me when I said we got the clear from the bank and explained it to me, or called me when this all came up, it would've been completely different. I hate not being in the loop, and I think its bad business practice to not keep clients aware of what is going on.

Clear to close usually means exactly that everything is cleared and all you have to do is close. We are in the process of buying a home and DH and I have experienced a lot of delays from our lender--They will not give us a clear to close unless we meet every condition in our commitment and a few that they threw in in the last couple of weeks. Your agent sounds like an @ss. My agent and mortgage broker have supported me through every step of this long drawn out process. We are hoping to get the clear to close tomorrow. Once we get the clear we were told we could go to closing ASAP. We are hoping to close on Friday or Tuesday. My on or about date was 2/28. Sorry you are going though similar home buying drama. Personally, if I could not go to closing I would set the soonest date possible and give my attorney power of attorney.
