I think there is a body of case law DIRECTLY relating to Hooters that you might want to read. Chat Icon

Hooters is considered partly "entertainment" - and for that purpose, they can discriminate based on gender and looks. (A male sued Hooters b/c they wouldn't hire him. Famous case.)



Liza, sadly, LOTS of things are done that shouldnt or cant be.
there was this whole clip on the radio this past summer about Abercrombie putting ONLY the hotties at the front of the store, and the "less" hot you are, the further back, and even into the stockroom you go..

as far as the OP, and Hooters, I can totally see how you were thrown off, Im picturing a totally shy friend of mine,and I would have been Chat Icon too at first and Chat Icon

but, God bless your friend, good for her.
If she feels comfortable and she's not made to feel embarassed or anything uncomfortable, more power to her.

The difference b/w Hooters and Abercrombie, though, is that Hooters legally allowed to hire in part based on looks and gender without it technically being "discrimination." Hooters is considered at least partly entertainment the last time I looked into it. It's been a few years, but I highly doubt that's changed. So, just as you wouldn't hire a male or an overweight Rockette or hire a female stripper at a male review, you don't have to hire male waiters or waitresses who don't "fit the look" at Hooters. (And no, I'm NOT saying waitressing at Hooters is like being a stripper...) I'm not saying I 100% agree with the classification of Hooters as entertainment (though I do see the logic behind it), but I think you'd be harder pressed to get Abercrombie classified as entertainment the way I see it. (I'm not aware of any case law identifying Abercrombie that way, anyway...)

I just recently found out that my SIL (who is painfully shy, even with us, the people she knows for 5+ years) tried working there 10 years ago. She said she was the hostess, not a waitress (I don't think she wore the outfit) and she quit after one day b/c they wanted her to go around selling T-shirts and she could not do it. She said she is embarrassed she did it (it actually came out by accident), and she only did it back then to get her boyfriend at the time mad (she was young). She said she didn't like a lot of the girls either (competitive).

She is a very pretty girl with a great shape but VERY timid, so it doesn't surprise me at all that she didn't feel comfortable working there.

In fleeting thoughts, I had"considered" applying there when I was younger and short on cash, but after thinking long and hard I always came up with it was something I did not agree with for myself. I have never even eaten, nor would I even eat there to be honest and I would never take my future children there. I just don't care for the concept.

I don't see anything wrong with it. In my opinion it's the same as working at any other restaurant. Yes the clothes might be a little skimpier than other places but they are still fully covered.

I don't see anything wrong with it. Everyone's gotta make a living and God knows how hard it is to make $$$ when you are in school. When I was in college I bartended and was a cocktail waitress in a few nightclubs in LI and NYC where I had to wear very risqué clothing. Honestly I was covered more than some of the girls that were out for a night on the town Chat Icon
