Need legal help regarding an autopsy
sorry for your lose. No legal advise but there are difference between medical examiner, pathologist and coroner (not MD) perhaps ask if a medical pathologist or forensic pathologist did the autopsy

If this were me i'd consider contacting the local news affiliate for a story. Sometimes that's the only way to get answers unfortunately. Sounds like a giant cluster

I would definitely start by calling the ME's office who did the autopsy. Speak to whomever is in charge and highlight the inconsistencies in the report. I'm not sure what can be done at this point unless you still have time to do an independent autopsy.
I"m so sorry for your loss. This is adding insult to injury. I can tell you from reviewing autopsy reports for years as part of my job, I sometimes wonder how supervised some of these ME's are. I mean, I guess if they are MD's they don't really need to be supervised, but I can tell you there is one in Suffolk County that I almost always question the credibility of the report. Not that I think the ME is lying or something sinister is going on, but there are almost always inaccuracies and missing information.

I am sorry you are dealing with this. I would ask yourself also, what is the outcome you are seeking? Does it have to do with insurance, wills, etc? Or is it more for personal edification? I don't really know that going to the media will help your grieving because that opens you up to so much public scrutiny. What will help you find peace in this grieving process? The medical examiner isn't customer service...I would manage your expectation accordingly. Again, I am very very sorry for your loss.

I am sorry for your loss. I agree with the above poster. What is your objective? Do you think a second autopsy needs to be done? Is this for life insurance? Yes, it appears a mistake was made. What is common is the ME used a cut and paste document and just filled in the paperwork incorrectly and left in the part about the gall bladder. Can you call the ME and ask if it was just a mistake calmly, or have someone else call on your behalf? But ultimately, what is the goal? I would focus on trying to heal yourself because a mistaken report is something to focus on and distract you from true healing. Again, I am sorry for your loss.
When my grandma passed away, I had said to my mom that grandma had mini strokes in front of me and it was so upsetting to watch. The doctor told my mom I was wrong, but of course the cause of death included ministrokes. My mom was angry at the doctors, but I think the doctor was just trying to help my mom ease her mind. So sometimes things are wrong, and you need to figure out how to process that.

The problem with this for me is I am questioning the rest of report. If they falsely gave information literally describing in detail a gallbladder that isn’t there, how do I know the description of say his heart is accurate? Maybe they put that in incorrectly too. This was a sudden unexpected death. When you put together their findings, A sudden death does not make sense. I have even had two doctors tell me someone does not die suddenly from what they found. There are other aspects of it that are questionable. I also had an attorneys office tell me they have been mixing up bodies and reports at this location.

I believe you can request a second autopsy, but it may be at some cost to the family. It can be done at the same place with a different pathologist, or someplace of your choosing.

I think given the additional information the only recourse is to speak to the ME and see what they say. Is it possible you are in denial about the death? Denial is a part of the grieving process and while the inaccuracy is definitely an issue it doesn't necessarily indicate further malfeasance on their part and they should give you an explanation. I hope you find the peace of mind you are looking for

If someone close to me died suddenly and unexpectedly, with no known health issues, I'd want answers too. Not because I'm in denial- because I would want to know what killed a young, healthy person. I think that is 100% normal. No it won't bring that person back- but I think everyone would want to know. To be able to say- my brother died of X, Y or Z. Not to mention- if it's something genetic, I'd think the family would want to know to be on the look out for something that could be an issue for them as well.
OP- did they end up listing anything as the cause of death? Or did they just say undetermined?
I would call the ME directly and bring up the fact that he had no gallbladder and yet the report spoke of it at length so you would like to know if there was a mix up or what the reason was.
I am not sure there is anything they can do at this point but I'd at least want them to explain the discrepancies.

Thank you. This is exactly how I feel. I am not in denial of what happened, but concerned if this error was in other parts of the report beyond this. The cause of death was kind of broad. There was a heart issue listed but not sure if that is what contributed unless it caused an arrhythmia. Two doctors I have spoken to think that could have happened. I plan on calling the ME office and speaking to the investigator.

If you still do not feel comfortable with the answers your received then you should call back. You need to begin healing and knowing the autopsy results make sense is a first step.
