Can you ever use a companies logo with out perrmission?
Can you ever use a companies name without permission?
Where does freedom of speac end and defamation or slander begin. I am so confused.

The company I work for has a program called the travel program. When you purchase the travel program, you become a Gullivers Referral Travel agent. Which means in accordance to the agreement that the GRTA that the person signs (Gullivers Referral Travel Agent) and the training manual you are to refer customers to us. The GRTA still makes the commission however they are not to be involved in the booking procedure.
Any GRTA that wants to do promotions, advertisements, marketing has to submit to the company for approval. The company wants to make sure that you are providing the correct information. Any wrong information can lead to serious lawsuits and a lot of angry people.
We prefer our GRTA's to not be involved in the booking procedure because of Liability and Omissins. If we give a quote and they pass it to someone else, it is possible they can misquote. Granted Fares are subject to change and not guaranteed until ticketed it's chances the company does not want to take. We already lost almost $1000 on a misquote. But thats what insurance is for
So you cant use a companies name or logo without their permission because of false advertising, and the risk of providing the wrong information.

I'm a legal admin assistant and my boss is the chair of our patent/trademark/copyright department at our lawfirm ... if you have any specific quesitons Deb, I'd be happy to ask him for you ..

I'm guessing here, but I"m sure that in due time (once Nextel's legal eagles get wind of it) they would be able to shut them down with some fancy schmantzy paperwork (i.e, threats of lawsuit)

probably for the same reason I didn't do anything with the person that made a LIWsucks site. Publicity good or bad is publicity. It backfires on the person that developes it because the company that so called s ucks receives more business. kinda funny, you know?

My business had a *****.com site against them and we put that poor person into the ground in paperwork and legal fee's. Just trying to learn more about it because I am facsinated.

It really is interesting.
We have ID cards that we provide to certain people and if they choose to cancel that service they have to surrendar their ID card. If they dont and we find out they used it, we'll go after them for defrauding the company.

Exactly, usually just being served the paperwork and being faced with the threat of being sued will force these infringing losers to go defunct .. often they KNOW full well they cannot and will not win if they fight it out - and since it takes YEARS to have these things litigated (and as we all know attorneys' fees are insane) , they pretty much just agree to shut down and avoid further litigation

Even if they did they would loose becaue of what they did. But the big question in a suit is the cost of the law firm that will handle yoru case.

OK so I plan to do copyright/trademark infringement...I should go to Law school first so that I can defend myself and afford legal fees.
