Any insight on what to do with this situation?

I am having A WEEK! And it's just the start of Tuesday. God save me.

Yesterday I received a call from a collections agency that I owe the NYC Dept of Sanitation $1200 for abandoning a vehicle in Brooklyn in August 2020. Turns out, a car I sold to DH"s friend in 2014 is somehow still registered to my name. I called the friend and he was confused too because he had moved out of state at the time, registered the car there for 5 years, moved back to NY and sold the car to someone else in 2019. He doesn't know if that person ever registered the car but assumes he did because he saw him driving it (unless he was using stolen license plates). He turned his plates in to the other state when he sold it to this other guy.

DH and I do not remember what we did with my license plates. We either turned them in or put them on a new car but we have no memory. Here's the kicker...both of us have moved since owning the car so I don't have any paperwork for it and DH's friend is going to look, but he likely doesn't have anything either.

How do I go about proving I didn't own the car in 8/2020? NYC told me they ran the VIN number. and it shows I own it. How can that be when it was registered in another state for 5 years?? Obviously, there is a disconnect someplace. I'm so frustrated. Any ideas?

Did you leave the registration sticker in the window when you sold it to your friend?

Do they know where the car is? Maybe the other person is still driving it, and you can prove they're paying for the registration.

If it's at an impound lot and you can access it, pay the $1,200 to get it back and sell it again for more than that.

Are you sure it’s legit and not a scam?

Can you ask the friend if he has any paperwork from when he either bought or sold the vehicle?

Perhaps you can search through NYS to see when if they have the records when you sold the vehicle and signed the title over.
https://dmv.ny.gov/records/general-information-about-dmv-records
Records retention period - The length of time we keep records is called the records retention period. The length of time we keep records is defined in the Vehicle and Traffic Law.2

Search - When you request records, we search DMV records to find the record you requested. We may or may not find a match. The fee you pay is for the search itself regardless of whether a match is found. These fees are not refundable. 3

That's the first thing I thought of.

I actually received something in the mail at least 6 months ago. I called and emailed NYC to see if it was a scam, which I thought it was because payment was to be mailed to Iowa. Lo and behold, when I spoke to the nice collections man yesterday, he was from the mid-west. He gave me a contact number for the Dept. of Sanitation and I spoke to someone at OATH and she was the one that actually gave me all the information.

Thank you!

To answer your other post, he is looking through his records to see if he has an insurance statement or anything that would prove he had the vehicle. He is definitely trying to help me but he hasn't had the car since 2019.

They told me they ran the VIN but that they wouldn't have access to out of state information so they can't verify it. Like I need this headache right now.

Ha! This would be a great idea. The most shocking part of the whole story is that it was still running up to 8/2020. When I sold the 2000 Nissan Maxima in 2014, it had over 200K miles. He told me he put another 100K on it in the time he owned it. What a glowing endorsement for Nissan LOL I have no idea where the car is now but it should be put out to pasture I would think

I really don't remember. Its so long ago. I can't even remember what we did with the plates. That would be helpful if I could.

Yeah as my husband did this once and they came after him with a warrant for unpaid tickets. He totally forgot to do that but we always tell people make sure you do as it was a pain going to court to prove that he didn't even own the car when the tickets were issued.

I love to hear this because I just bought my Maxima off lease because it was way too expensive to lease a new one with the car shortages.
I love the car so I was ok with buying it and the mileage was crazy low.
But wow, this is an awesome endorsement! lol

find out who he sold the car to and try get them in civil court, but really it should not be that difficult to show the car wasn’t registered in your name. this is just ridiculous

Do you have anything like a bill of sale when you sold it?

Would a Carfax report show all previous sales and registrations?

Great idea. This may be the way to go, if the records don't turn up!
