any teachers due in July or august?

I'm due in August. I'm wondering if I'm still entitled to 6 weeks maternity leave.... what do you think? It would really help because I want to take off until January, so if they would pay for the first 6 weeks it would be great!

Your FMLA starts up again since there is no place for you to work during July and August-- this is what I was told when I had my child.

Honestly each district is different in their policy. I can't answer about the paid part but I know for sure about the FMLA

It depends when you deliver in Aug. Your 6 weeks starts when you have your child. So if you deliver the last weeks in Aug, you would get paid for the 1st 5 weeks of school. Does that make sense?

your district is only required to pay you 6 weeks after you give birth. In my district they pay you for 8 weeks if you have a C section. Therefore, those that give birth in July or August, especially July, "lose" that money in a sense because the 6 or so weeks they would have had off during the school year don't get used just because it was during the summer vacation.
Even if someone was to give birth during the christmas break, lets say the begining of that week, they would kind of lose a week that they would have gotten had the week been during a non vacation.

Talk to your building union rep BEFORE you talk to an administrator. Also bring a union building rep with you to the meeting with the administriator when you do talk about your leave. That way there is no he said/she said at a later date.

I am going through this right now. I have a very difficult position to find a replacement for as I teach mostly AP and college courses (everyone with experience in them already has a tenured position) and the district is trying to give me less than what other teachers have received.

FMLA is federal law.

Are you tentured?

Do you have a copy of your contract? It might be outlined in there.

Sorry if I seem "skeptical" when it comes to the interpretation but since I've started teaching in my district all of the different administrators have tried to interpret it differently because it is not written in stone in our contract. We are also working w/o a contract so as you can imagine I do not trust school boards or adminstrators at all right now.

Good luck and check with your union first.

I'm due at the end of June (after school is out) and am concerned about the same thing. I thought I'd be able to take my 6 weeks paid at the beginning of next school year but the more I read and speak to people, the more I'm thinking this isn't happening. I haven't "come out" yet at school, but once I do (right after vaca) this will be my first order of business.

I have tenure, but I haven't "come out" yet at school either. I will definitely speak to my union rep! Thanks for the heads up and I'm going to dig up my contract and check it out (although we're in the negotiation process because it expires in June Chat Icon )

I am due in April and just found out that I had misunderstood my district's policy. I DO get the FLMA by law, but I get no time paid. My unpaid time starts the day I take leave. The only paid time I will have is if I take all of my sick days. I had figured on six weeks paid to get me through to almost the end of the year, but that is not the case. Now I understand from asking around that it can really vary from district to district. Find out all you can as early as you can!

I'm pretty sure it's standard in education to have to use your sick days to get paid leave. I've heard that some districts (like my own) will let you "borrow" days from a communal bank if you don't have enough to cover a 6-week period (but you don't have to give back).
