How does unemployment work
on the companys end of the situation?
Once they lay someone off, do they have to pay the weekly amount? or is that something that is somehow covered?

The State Unemployement Fund or what ever pays the former employee.
The company will receive notices of employees being paid out. The experience rating may change after a claim is made. That goes to the payroll company so they charge the correct amount to the company.

From what I know, the company has already paid into UI, at a specific rate. if say you were to hit them with it, they get a notice and they either A. accept that the $ will be deducted from their account and then they don't need to do anything further, or B don't agree, where they then fill out the form as to why and UI decides if its legit or not. usually the employer never wins, no matter what, but it has happened on the rare occasion. when the $ drops below a certain amount the employer must replenish their UI account and its charged at the new rate (which will have gone up in the time since the last time they put $ in the account) some employers don't get hit that often and they don't replenish the funds since they are maxed out in the account for what is needed.

so all along they've been paying into an Unemployment account? and if they have enough in there, it's not costing them anymore?

so i have a question...
let's say you are fired & you apply for unemployment
then your employer won't allow you to collect, how does that work?
what are the chances that at the hearing your unemployment benefits are denied
we hear rumours all the time at this company
my boss goes down to the hearing to make sure you don't collect
would i have to bring my own lawyer with me?
was just wondering how often benefits are denied when the employer shows up at the hearing
last time he let someone go, he made someone (get this) come with him to tell them that the person wasn't doing their work.
isn't that unethical?
i've never heard of that before

so all along they've been paying into an Unemployment account? and if they have enough in there, it's not costing them anymore?
it doesn't cost them anymore once they reach there set maximum, I belive the state creates that on info you give them i.e. amont of employees, salires etc. but once they are hit with someone collecting UI they must replenish the account ( i think in monthly payments)

every single time I've known of an employer (sometimes even with proof and a lawyer with them) fight it, they have lost, no matter what. We even had an employee who did not legally work enough days to collect and still got it! We also had a situation were an employee erased her entire computer (which it is illegal to do that) and she still freakin got it. Its insane, i don't want to start any drama and i could be completly off base but i have *heard* it is because the state would rather an employer pay for the employee, then risk them going on welfare and the state having to pay, so they do what they can... This could be untrue, but it is the belief of many, from what I have heard.

My boss is crazy and since it's a small office, there are always rumourrs flying around. No one in the office has been let go in 3 yrs but they live in daily fear of getting fired b/c they won't be able to collect.
I have never heard of an employer going down and the employee not getting their unemployment benefits.
Just wondering if anyone had experience with this.
He has too much time on his hands. The business is a toy from his parents to keep him busy.
