Maternity Leave

Does anyone know the amount of time you are given for maternity leave? I know it is 6 weeks but is it paid? What if you have the baby during the summer months, does your 6 weeks start when you have the baby or when school begins in September? I have been hearing many different views on this.

When I went on my maternity leave it was paid but I had to use my sick time. I received 8 1/2 weeks because that is when my dr. cleared me for (I had a c-section). Also, if you have the baby in the summer, the days start counting from there!

I know districts vary slightly but I teach at a district on LI and this is the policy in my district.

If you have a vaginal birth you can take 6 weeks. You get paid for the 6 weeks if you have sick days to cover those 6 weeks. If you have a c-section, you can take 8 weeks. Same thing, only paid if you have the sick days accumulated.

As for the summer, if you have a baby in July let's say, after school is out, you don't get paid for anything. You get your six weeks off but you don't get paid because technically you already got paid over the summer.

Here is my situation, I am due June 20th. Our last day of school is June 25th. If I have the baby on June 20th lets say, I will ony have to use 4 of my sick days. I get the whole summer off but I don't get any additional pay over the summer. I will return in Sept.

I had my baby on June 26 and did not get paid for the 6 weeks Chat Icon Chat Icon is due in July and similaraly I will not get paid.

It strikes me as really unfair and when I told the union I was told to "plan it better" Chat Icon

DS was born 8/6. The six week clock began the day he was born, and I was paid for two weeks once school opened in Sept.

However, FMLA works in your favor here, bc that clock doesnt start until school opens, and that you have 12 weeks. So FMLA began in Sept, and ran until late Nov.

Thank you so much for this information. I was getting mixed answers from everyone who was not a teacher over this vacation week. So I figured who would know best...us teachers! Thats great that FMLA doesn't begin until school starts. FMLA for 12 weeks keeps your benefits without getting paid?

Exactly. Your FMLA is suspended during the summer because FMLA is also to hold a position for you and in the summer there is no position for you so it count against you. For me for example I had my son in May. I had a c-section. I never went off payroll because I had the days to cover 8 weeks. However my FMLA was not done so I could have taken Sept too (unpaid) if I wanted. Does that make sense??

ETA Also in my district, if you go out early your FMLA starts then though it doesn't eat into your 6 or 8 weeks. Hope that makes sense
