Unbelieveable...
OK, so this story is disgusting. A woman was raped in the parking garage of a hotel in CT (in front of her 2 children). She is suing the hotel saying they did not do everything they could to prevent the attack.
I don't know all the details, so I am not sure how I feel about her lawsuit, HOWEVER, the hotel's lawyers are saying that she should hold part of the blame for being raped because she didn't do everything she could to keep herself safe. How can they say that as a defense and think that people will find that to be an acceptable and appropriate response? Ugh, that is just wrong to put the blame on her for being raped.

Even if the hotel and their lawyers truly feel that she was partially responsible for her own rape in front of her 3 and 5 year old children (which is BS by the way), don't they realize what freaking disgusting, moronic, insensitive, douchebag$ they look like in making a claim like this to defend her lawsuit?
And like I said above, we don't know all the details, so it could be that this woman doesn't have a case against the hotel ... but for them to reply with this as their defense is totally disgusting.

In a perfect world rape would not exist.
I highly doubt the woman was waving a sign that said "Rape Me."
I would think it difficult for someone to prove she did not reasonably protect herself.

I agree with you. Let's say she was in the middle of NYC and the guy pulled her into a dark alley and raped her. Would she be sueing the city of NY? The NYPD? For not protecting her? This is a criminal, not a civil, matter.

Like I said in the original post, we don't know the entire story. Maybe something happened at the hotel that put her safety at risk. But maybe it didn't. I was saying that regardless of whether or not her lawsuit against the hotel has merit, it is absolutely deplorable that the hotel lawyers would use the defense that it was her fault at all. Yuck... makes me sick.

Disgusting to say the least. However, I'm not surprised. More times than not when a woman is raped, people will always somehow find fault with the victim as if to imply that she is somehow responsible for her rape. Makes me sick to my stomach. This is why so many rapes go unreported.

So in essence what they saying is that their hotel is not safe since they cannot guarantee safety on their premises and it is up to each of the costumers to protect themselves on their premises.

It depends on the circumstances. If the hotel had prior notice of the parking lot being unsafe, crimes committed, etc, they had a duty to fix that problem.
However, their defense is disgusting - and from a marketing perspective, I can't imagine ANY woman patronizing that hotel.

I have to say I respectfully disagree with this. The hotel has a duty to make the parking garage safe. I don't know the details - but I think there is a big difference between being pulled into an alley in a public area and being raped and being attacked and raped in a private garage. They have a duty to try to keep you safe. I would think they would need to have adequate lighting, video cameras, security to do their best to ensure that things like that don't happen. They can't protect everyone (say you are raped by another guest) but it should hopefully keep those who are looking for trouble out of their private garage.

I am not sure that anyone is saying the hotel should be sued..so I don't necessarily think you are in the minority.
the ONLY way I can see the suit being a good thing is if the hotel had previous complaints about darkened areas, lights that were out...weirdo rapist types hanging out in the parking lot...etc...and they didn't act upon them.
I am honestly flabbergasted that ANYONE could insinuate that it was her fault.
the audacity of that accusation...it's just incomprehensible to me.
and I am sad to say, I don't agree that it had to be a man. it could be anyone that wants to deflect blame and WIN a law suit.
I too will be taking marriott off my list. and their subsidiaries as well.
