NYC policy on maternity..I'm due in June
As of right now I have 20 days in my C.A.R... I know I can borrow up to 20 days too. I'm due June 21st ...a week before school is out. I'm assuming as of September when it's time to go back I will not get paid b/c I'm over the 6 or 8 weeks even though I have the days in my bank. However, I think i can be on FMLA for 8 weeks??? Can someone please clarify this. I'm excited to have the summer off but I was hoping to be able to take more time off and get paid.

I am 30 weeks almost 31 and ready to delivery soon. However, I was misinformed by several people about the additional 20 days that I can borrow from the city. I was so confused and I went to 65 court street and i sat down with HR and I was told that If you have days already in the bank you will have to use those days. Then once those days are used then you are on your own. I was thinking the same thing about the 20 days I can borrow from the city. In other words, the only way you can borrow 20 days is if you go on maternity leave and you have NO DAYS!!! That is the only way you can borrow the 20 days. If you have days already than you can't borrow. I hope this will help you. Also, at the workshop I was told the same thing. I may have to go back at my 6 weeks.

This must be a recent change- I took leave in early 2007 and I used my CAR up and then I borrowed 20 days. Then there is this weird "grace period" of 30 days where you get paid for weekends and holidays.

My friend is coming back from maternity leave next week. She borrowed time. I think Court Street is in conflict!

Do you know if you can work it out to buy the days back? Like can you have the days docked from your check or do you have to wait to gain them back.

Do you mean borrowed days? I believe you can instruct your payroll sec to deduct the days from your check or you can earn them back each month.

Yes, that was what I meant. The borrowed days would take two years to get back to zero. I am sure with a newborn I can't imagine not having to take off a day for the next 2 years!

I was out in 2006 for maternity leave. I was out my 6 weeks, I only had about 14 days in my CAR. I was out about 3 weeks after the 6 and I borrowed those days.
You can borrow days into that 30 day grace period. The grace period has something to do with your medical as well. If you dont return 30 days after your 6 weeks, you could be taken off medical, but you can definitely still borrow.My friend just came back in Sept and she borrowed time too.
You will remain negative until you pay them back your days however long that might take. I am still negative like 7 days 3 years later. I still take days off. My secretary told me that you cant really get in trouble for being negative due to maternity leave, and that you are still entitled to your 10 days per year if needed. Whatever you dont use will be "paid back" however long that might take.

I had my DD on June 18th...I simply used days in my sick bank...I used 9 days till the end of the school year. I stayed on payroll....got paid throughout the summer and never had a glitch in my paychecks.

I am hearing mixed info as well.. even on here. i plan on going to one of the maternity workshops the DOE offfers.
I have no idea if any of this is true but i heard that you take your 6 weeks. you only get paid in those 6 weeks for the number of days you have in your CAR. so if 6 weeks is 30 days, and you have only 20 days you only get paid for the 20 days and unpaid for the last 10 days. I know nothing about this borrowing up to 20 days. However, someone told me you can only use a max of 30 days from your CAR ( i guess if you have 100 days banked they dont want you taking 100 days paid). i also heard that the six weeks doesnt count over holidays/vacations so if i takie 4 weeks and that brings me to the last day of school, I would technically still get an extra 2 weeks at the beginning of the school year because the summer is a vacation time.
then you can take a FMLa for an additional 6 weeks, but that is unpaid
again i am not claiming any of this is true it is what people at work who know im PG have told me. But I will be going to a workshop to find out for sure!
ETA i believe you can borrow days anytime. say you didnt even recently have a baby, but you have sick kids ect and you have no days left, you can still call in sick it isnt a problem. you willjust owe a day. so the following month you wont earn a sick day. there are so many people that I work with that own 8 even 12 days.
